the ownership <strong>of</strong> copyrights, or <strong>of</strong> inventions or discoveries made by employees<br />

<strong>of</strong> the University entirely outside <strong>of</strong> their duties with the University<br />

and without the use <strong>of</strong> University facilities, resources, or financial support.<br />

PROCEDURE ON PATENT MATTERS<br />

Sec. 18. (a) A disclosure <strong>of</strong> any invention or discovery made by an<br />

employee <strong>of</strong> the University, or resulting from research carried on under the<br />

direction <strong>of</strong> an employee, in which the University may have an interest shall<br />

be submitted promptly by such discoverer to his supervisor or administrative<br />

<strong>of</strong>ficer. Such <strong>of</strong>ficer shall append thereto a statement setting forth his opinion<br />

concerning the scientific, technical, and economic merit <strong>of</strong> such discovery,<br />

the likelihood and desirability <strong>of</strong> obtaining a patent, and an estimate <strong>of</strong> the<br />

commercial possibilities <strong>of</strong> such a patent, and transmit such disclosure and<br />

opinion to the University Patent Committee.<br />

(b) The Patent Committee shall review related data and information and<br />

make recommendations concerning financial terms and problems concerned<br />

with the development and administration <strong>of</strong> such inventions and discoveries,<br />

and patents secured thereon. The Committee shall make recommendations to<br />

the President, with the concurrence <strong>of</strong> the Chairman <strong>of</strong> the University Research<br />

Board, concerning the disposition and the terms <strong>of</strong> administration <strong>of</strong><br />

such inventions and discoveries. If he concurs, the President shall transmit<br />

such recommendations to the Board <strong>of</strong> Trustees for final action.<br />

(c) The determination as to what portion <strong>of</strong> net income shall be paid<br />

to the inventor or discoverer, after the payment <strong>of</strong> costs <strong>of</strong> securing a patent<br />

and <strong>of</strong> development and administration, from a patent held by the University<br />

or transferred by it to the University <strong>of</strong> Illinois Foundation shall be studied<br />

by the University Patent Committee, which shall make a recommendation<br />

to the President. In most cases, the University contribution in use <strong>of</strong> facilities<br />

and resources will be significant and, therefore, the inventor will have little<br />

real claim to compensation over his regular University salary. In such cases,<br />

the University Patent Committee shall recommend that the proportion <strong>of</strong> net<br />

income assigned to the inventor should fall in the range <strong>of</strong> 10 to 15 per cent<br />

<strong>of</strong> net income. In unusual cases, in which the University contribution is<br />

obviously less, this percentage allocation to the inventor may go to 25 per cent<br />

and, in rare cases, the rate may be higher.<br />

(d) No final decision shall be reached as to where title to a patent shall<br />

vest, nor shall there be transferred to any individual or agency the rights<br />

(including a share in the net income) in an invention or discovery in which<br />

the University has an interest, without the approval <strong>of</strong> the Board <strong>of</strong> Trustees.<br />

COPYRIGHTS<br />

Sec. 19. (a) The right to copyright a work or to assign this right to a<br />

publisher normally belongs to the author <strong>of</strong> the work. However, when the<br />

author is specifically commissioned by the University or one <strong>of</strong> its departments<br />

to prepare a manuscript or report, the manuscript and all rights to it shall<br />

belong to the University.<br />

(b) Research and service pamphlets and bulletins may or may not be<br />

copyrighted, at the discretion <strong>of</strong> the department issuing the work.<br />

(c) Books published by the University Press are copyrighted as provided<br />

in Section 10.
