and Procedure" adopted by the Board <strong>of</strong> Trustees which gives the President<br />

authority to make traffic and parking regulations and such changes therein as<br />

conditions may warrant.<br />

Director L. A. Bryan <strong>of</strong> the Institute <strong>of</strong> Aviation, who has been serving as<br />

the Chairman <strong>of</strong> the Traffic and Parking Board, made a statement in support<br />

<strong>of</strong> these recommendations.<br />

On motion <strong>of</strong> Mr. Williamson, the recommendations <strong>of</strong> the President<br />

were approved.<br />

EXECUTIVE SESSION<br />

Before the Board convened for its regular meeting, an executive session<br />

was requested and ordered for consideration <strong>of</strong> the following items<br />

<strong>of</strong> business.<br />

AIR RIGHTS OVER PROPERTIES ADJOINING UNIVERSITY<br />

OF ILLINOIS AIRPORT<br />

(33) In the negotiations with the Civil Aeronautics Administration for federal<br />

funds for the construction <strong>of</strong> the first unit <strong>of</strong> an Administration Building and<br />

Control Tower at the University <strong>of</strong> Illinois Airport, the University has been<br />

asked to declare that it will acquire, either through purchase or by easement by<br />

1961, control <strong>of</strong> the air rights over certain areas at each end <strong>of</strong> the north-south<br />

runway. The Civil Aeronautics Administration requires assurance that the approach<br />

flight path will not be obstructed on any airport which it operates or<br />

assists in improving. Aside from the federal requirements, it is important to the<br />

University to have control <strong>of</strong> the air rights over these areas, but it had not been<br />

anticipated that any steps would be taken immediately. In view <strong>of</strong> the request<br />

from the Civil Aeronautics Administration, the University should begin negotiations<br />

for easements.<br />

The owner <strong>of</strong> the property at the north end <strong>of</strong> the runway is interested in<br />

selling his land to the University but in earlier negotiations indicated an unwillingness<br />

to sell or grant an easement without a commitment on the part <strong>of</strong> the<br />

University to purchase the land. Since funds are not currently available, it is<br />

impossible to make a commitment for such a purchase and negotiations for the<br />

acquisition <strong>of</strong> an easement will take some time. In view <strong>of</strong> this situation the<br />

Civil Aeronautics Administration is willing to accept, in lieu <strong>of</strong> a commitment,<br />

a declaration by the Board <strong>of</strong> Trustees <strong>of</strong> the University <strong>of</strong> Illinois that it<br />

agrees that acquisition <strong>of</strong> air rights over the area is desirable, that the Board<br />

will seek funds necessary to acquire the property by purchase or air rights oyer<br />

the property on or before March 29, 1961, and that if any building construction<br />

on this area is started in the meantime the Board will take whatever steps it<br />

can within its statutory powers to prevent or abate the construction.<br />

The Director <strong>of</strong> the Institute <strong>of</strong> Aviation and the Vice-President and<br />

Comptroller recommend that the Board <strong>of</strong> Trustees adopt the following resolution.<br />

Resolution<br />

WHEREAS the Board <strong>of</strong> Trustees <strong>of</strong> the University <strong>of</strong> Illinois, a public<br />

corporation, proposes to improve its airport facilities by the construction 01<br />

an administration building; and<br />

WHEREAS the Federal Government proposes to participate in this improvement<br />

by making a substantial grant to the cost <strong>of</strong> this project, and<br />

WHEREAS the Federal Government, in making such grant requires assurances<br />

that the Board <strong>of</strong> Trustees <strong>of</strong> the University <strong>of</strong> Illinois will within its<br />

statutory and constitutional authority take any action available to it which may<br />

be required to keep the area trapezoid in shape, extending outwardly 2000 feet<br />

from a point located 200 feet outward from each end <strong>of</strong> the N/S runway<br />

measured along the centerline there<strong>of</strong> as projected outward, the said zones<br />

being 400 feet wide at the said beginning point, measured equidistant on each<br />

side <strong>of</strong> the projected centerline, and increasing to a width <strong>of</strong> 800 feet at its outer<br />

extremity, measured equidistant on each side <strong>of</strong> the projected centerline free 01<br />

obstacles that will interfere with the flight path.
