APPROPRIATION FOR HORSE-RADISH RESEARCH<br />

(14) An Act <strong>of</strong> the Seventieth General Assembly <strong>of</strong> Illinois (Senate Bill 280),<br />

approved July 6, 1957, appropriated $S,000 to the University for research on<br />

diseases and insects causing damage and destruction to the vegetable known as<br />

horse-radish and on improvement <strong>of</strong> varieties and cultural practices, and for<br />

recommending to growers remedies which may eliminate menaces to the future<br />

crop <strong>of</strong> this vegetable in Illinois and methods <strong>of</strong> improving it.<br />

The Dean <strong>of</strong> the College <strong>of</strong> Agriculture, the Vice-President and Provost, and<br />

the Vice-President and Comptroller recommend that $2,500 <strong>of</strong> this appropriation<br />

be assigned for the year 1957-58 to the Department <strong>of</strong> Horticulture for horseradish<br />

research.<br />

The remaining $2,500 will be included in the budget for 1958-59.<br />

I concur.<br />

EASEMENT TO NORTHERN ILLINOIS WATER CORPORATION<br />

(15) On May 28, 1957, the Board <strong>of</strong> Trustees granted an easement to the Illinois<br />

Power Company for the use <strong>of</strong> St. Mary's Road between First Street and the<br />

Illinois Central Railroad. The Illinois Power Company has sold a portion <strong>of</strong> the<br />

land owned by it to the Northern Illinois Water Company, which requests joint<br />

use <strong>of</strong> the roadway. The Director <strong>of</strong> the Physical Plant Department and the Vice-<br />

President and Comptroller recommend granting <strong>of</strong> the easement and adoption <strong>of</strong><br />

the following resolution to authorize an instrument <strong>of</strong> conveyance.<br />

Resolution<br />

Be it, and it is hereby, resolved by the Board <strong>of</strong> Trustees <strong>of</strong> the University <strong>of</strong><br />

Illinois, a public corporation <strong>of</strong> the state <strong>of</strong> Illinois, that the Comptroller and the<br />

Secretary <strong>of</strong> the Board <strong>of</strong> Trustees be, and they hereby are, upon the approval <strong>of</strong><br />

the Legal Counsel, authorized to execute, acknowledge, and deliver in the name <strong>of</strong><br />

and on behalf <strong>of</strong> this corporation, such instrument <strong>of</strong> conveyance, contract, or<br />

other document or documents, as to them may seem necessary or desirable, in order<br />

to effectuate a conveyance to Northern Illinois Water Corporation <strong>of</strong> a right <strong>of</strong><br />

way easement over and upon, and with the right to construct and maintain a<br />

roadway thereon, traverse, travel upon, cross, and use for usual road purposes, a<br />

strip <strong>of</strong> land not more than 12 feet wide, with an over-all width <strong>of</strong> 18 feet to<br />

provide for drainage, extending from St. Mary's road south approximately J4 mile<br />

along a line between the SW }4 <strong>of</strong> the NE l A <strong>of</strong> Section 24 and the SE % <strong>of</strong> the<br />

NE Yx <strong>of</strong> Section 24, all in T 19 N, R 8 E <strong>of</strong> the 3rd P.M., Champaign County,<br />

Illinois, on the site <strong>of</strong> the existing cindered farm lane, the exact location to be set<br />

forth in the instrument <strong>of</strong> conveyance herein authorized to be entered into, said<br />

right <strong>of</strong> way easement to be non-exclusive, and said Northern Illinois Water Corporation<br />

to agree to guarantee, and, in the event <strong>of</strong> any default by Illinois Power<br />

Company, to assume, the obligation <strong>of</strong> Illinois Power Company to construct and<br />

maintain thereon, in a manner acceptable to duly authorized representatives <strong>of</strong> this<br />

public corporation, an all-weather roadway 12 feet wide, with an over-all width <strong>of</strong><br />

18 feet to provide for drainage, at the sole expense <strong>of</strong> said Illinois Power Company<br />

and said Northern Illinois Water Corporation to agree to indemnify this<br />

public corporation against any loss or damages arising out <strong>of</strong> liability for personal<br />

injury, including death, or property damage, to any persons whomsoever, caused by<br />

° r attributable to the construction, maintenance and/or use <strong>of</strong> said roadway by said<br />

Northern Illinois Water Corporation. The easement grant shall provide for a right<br />

°t way easement for an original term beginning with the date <strong>of</strong> said grant, and<br />

ending on August 5, 1967, and shall contain a provision authorizing renewal for an
