(b) No person employed by the University shall have any interests incompatible<br />

with those <strong>of</strong> the University.<br />

(c) Full-time employees shall not receive compensation for services<br />

within the University in excess <strong>of</strong> a normal schedule, except for a reasonable<br />

amount <strong>of</strong> instruction in the Division <strong>of</strong> University Extension or for the<br />

grading <strong>of</strong> special examinations (outside regular course work) stipulated by<br />

the University, all to be done during <strong>of</strong>f-duty hours. Exceptions may be made<br />

to this rule in special cases which are approved by the dean <strong>of</strong> the college <strong>of</strong><br />

which the employee is a member, provided that if such additional payments<br />

exceed a nominal amount, the advance approval <strong>of</strong> the President or <strong>of</strong> the<br />

Vice-President and Provost shall be secured. These exceptions shall be held<br />

to a minimum.<br />

(d) The responsibilities to the University <strong>of</strong> full-time members <strong>of</strong> the<br />

academic staff are held to be fulfilled when a teaching load appropriate to the<br />

rank and program is carried, an appropriate amount <strong>of</strong> productive scholarly<br />

research, aid in a program <strong>of</strong> public service, and a reasonable share <strong>of</strong> committee<br />

assignments is performed. Such staff members may carry on some<br />

pr<strong>of</strong>essional or business activities <strong>of</strong> an income-producing character, so long<br />

as such activities are compatible and not in conflict with University interests.<br />

The head <strong>of</strong> the department <strong>of</strong> which the employee is a member should know<br />

and approve <strong>of</strong> these activities outside the University.<br />

TENURE OF ACADEMIC STAFF<br />

Sec. 38. (a) Unless otherwise provided in these Statutes (and in the<br />

absence <strong>of</strong> some special written agreement approved by the President <strong>of</strong> the<br />

University with the consent <strong>of</strong> the appointee) the tenure for the various<br />

members <strong>of</strong> the academic staff shall be as stated herein, except that first<br />

appointments or temporary appointments may be made for shorter periods.<br />

(1) An appointment as pr<strong>of</strong>essor or associate pr<strong>of</strong>essor shall be for an<br />

indefinite term.<br />

(2) An appointment as assistant pr<strong>of</strong>essor, or to the administrative staff,<br />

shall be for a period not longer than two years from September 1 <strong>of</strong> the first<br />

year <strong>of</strong> the legislative biennium.<br />

(3) Appointments to lower ranks shall be for not more than one year.<br />

(b) The appointment <strong>of</strong> any person for a definite term does not carry<br />

any guarantee or implication that the. Board <strong>of</strong> Trustees will renew the<br />

appointment at its termination, even though the appointee may have discharged<br />

his duties satisfactorily. Any appointment, if accepted, must be<br />

accepted with this stipulation.<br />

(c) Tenure may be terminated by (1) honorable retirement; (2) acceptance<br />

<strong>of</strong> resignation; (3) discharge for cause.<br />

(d) Cause for discharge shall consist <strong>of</strong> conduct seriously prejudicial to<br />

the University through deliberate infraction <strong>of</strong> law or commonly accepted<br />

standards <strong>of</strong> morality, neglect <strong>of</strong> duty, inefficiency or incompetency. The<br />

enumeration <strong>of</strong> causes for discharge shall not be deemed exclusive, and the<br />

Board <strong>of</strong> Trustees reserves the power to discharge for other causes, but it is<br />

to be distinctly understood that this power will be exercised only under exceptional<br />

circumstances and then only for conduct which is clearly prejudicial to<br />

the best interests <strong>of</strong> the University.<br />

(e) An appointee on definite tenure shall not be removed before the expiration<br />

<strong>of</strong> his term <strong>of</strong> service, nor shall an appointee on indefinite tenure be
