Now, Therefore, Be It Resolved That the Board <strong>of</strong> Trustees <strong>of</strong> the University<br />

<strong>of</strong> Illinois shall make application to the Secretary <strong>of</strong> Health, Education, and<br />

Welfare for and secure the transfer to it <strong>of</strong> the above-mentioned property for<br />

educational use upon and subject to such exceptions, reservations, terms, covenants,<br />

agreements, conditions, and restrictions as the Secretary <strong>of</strong> Health, Education,<br />

and Welfare, or his authorized representatives, may require in connection with<br />

the disposal <strong>of</strong> said property under said Act and the rules and regulations issued<br />

pursuant thereto; and<br />

Be It Further Resolved That H. 0. Farber, Comptroller <strong>of</strong> the Board <strong>of</strong><br />

Trustees <strong>of</strong> the University <strong>of</strong> Illinois, be and he is hereby authorized, for and on<br />

behalf <strong>of</strong> the University <strong>of</strong> Illinois, to do and perform any and all acts and<br />

things which may be necessary to carry out the foregoing resolution, including<br />

the preparing, making, and filing <strong>of</strong> plans, applications, reports, and other documents,<br />

the execution, acceptance, delivery, and recordation <strong>of</strong> agreements, deeds,<br />

and other instruments pertaining to the transfer <strong>of</strong> said property, and the payment<br />

<strong>of</strong> any and all sums necessary on account <strong>of</strong> the purchase price there<strong>of</strong> or on<br />

account <strong>of</strong> fees or costs incurred in connection with the transfer <strong>of</strong> said property<br />

for surveys, title searches, appraisals, recordation <strong>of</strong> instruments, or escrow costs.<br />

On motion <strong>of</strong> Mr. Swain, this recommendation was approved, and<br />

the foregoing resolution was adopted by the following vote: Aye, Mr.<br />

Herrick, Mr. Hughes, Mr. Johnston, Mr. Livingston, Mr. Swain, Mrs.<br />

Watkins, Mr. Williamson; no, none; absent, Mr. Bissell, Mrs. Holt,<br />

Mr. Nickell, Mr. Stratton.<br />

ACQUISITION OF PROPERTY AT 610 EAST JOHN STREET.<br />

CHAMPAIGN. ILLINOIS<br />

(34) On November 21, 1957, the Board <strong>of</strong> Trustees authorized the institution <strong>of</strong><br />

proceedings in eminent domain for the acquisition <strong>of</strong> the property at 610 East<br />

John Street, Champaign, Illinois, because the owner would not agree to sell except<br />

at a price University <strong>of</strong>ficials deemed excessive and could not recommend. The<br />

property is needed as part <strong>of</strong> the site for a new student services building.<br />

Proceedings were instituted in the Circuit Court <strong>of</strong> Champaign County and<br />

the case was set for trial. At a "pre-trial" conference <strong>of</strong> representatives <strong>of</strong> the<br />

owner and <strong>of</strong> the University, called by the Judge who was to hear the case, the<br />

owner agreed to sell at a price <strong>of</strong> $45,000 and University representatives agreed<br />

to present this proposal to the Board <strong>of</strong> Trustees. While the price is somewhat<br />

above appraisals made <strong>of</strong> the property for the University, it is within the formula<br />

authorized by the Committee on Buildings and Grounds governing negotiations for<br />

property purchases. The difference between this price and appraisals would not<br />

justify the expense <strong>of</strong> further litigation.<br />

The Director <strong>of</strong> the Physical Plant Department, the Legal Counsel, and the<br />

Vice-President and Comptroller recommend the purchase <strong>of</strong> this property, which<br />

is described in the minutes <strong>of</strong> the Board <strong>of</strong> Trustees meeting <strong>of</strong> November 20,<br />

T 957, pages 991 to 993, at the agreed upon price <strong>of</strong> $45,000, the terms <strong>of</strong> payment<br />

and other conditions relating to the acquisition <strong>of</strong> the property to be subject to<br />

further negotiations and approval <strong>of</strong> the University.<br />

Funds are available in the state capital appropriations to the University for<br />

J 957-59-<br />

I concur and recommend that the Comptroller and the Secretary <strong>of</strong> the Board<br />

be authorized to execute the necessary documents upon approval <strong>of</strong> the same and<br />

<strong>of</strong> the title to property by the Legal Counsel; and that the action <strong>of</strong> the Board<br />

adopting the resolution for condemnation <strong>of</strong> this particular property, as printed<br />

on pages 992 to 993 <strong>of</strong> the November 20, 1957, Board minutes, be rescinded.<br />

On motion <strong>of</strong> Mr. Williamson, the purchase <strong>of</strong> this property at a<br />

price <strong>of</strong> $45,000 was authorized and the other recommendations were<br />

approved. This action was taken by the following vote: Aye, Mr.<br />

Herrick, Mr. Hughes, Mr. Johnston, Mr. Livingston, Mr. Swain, Mrs.<br />

Watkins, Mr. Williamson;' no, none; absent, Mr. Bissell, Mrs. Holt,<br />

Mr. Nickell, Mr. Stratton.
