providing for extension work or teaching services. Policies and procedures<br />

set forth in this section and in Section 13 shall apply to such grants and contracts,<br />

except that funds appropriated by the United States Government to the<br />

Agricultural Experiment Station or the Agricultural Extension Service shall<br />

be administered by the College <strong>of</strong> Agriculture.<br />

DRAFTING AND EXECUTION OF UNIVERSITY CONTRACTS<br />

Sec. 15. (a) Contracts shall be drafted in tentative form by the University<br />

<strong>of</strong>ficer best acquainted with the subject matter there<strong>of</strong> and in whose<br />

department lies the responsibility for performance, and approved by the Vice-<br />

President and Comptroller <strong>of</strong> the University, unless otherwise provided by<br />

the statutes <strong>of</strong> the University.<br />

(b) All contracts prior to the execution there<strong>of</strong> shall be approved as to<br />

legal form and validity by the Legal Counsel, such approval to be endorsed in<br />

writing on the contract, provided that such approval and endorsement shall<br />

not be required with respect to individual contracts or extensions or renewals<br />

there<strong>of</strong> the form <strong>of</strong> which has been previously approved by the Legal Counsel<br />

and which contain no substantive changes or additions, other than those pertaining<br />

solely to the description <strong>of</strong> the project, the amount involved, and the<br />

term <strong>of</strong> the contract or extension.<br />

All contracts shall be executed at least in duplicate, and the original<br />

there<strong>of</strong> shall be filed with the Secretary <strong>of</strong> the Board <strong>of</strong> Trustees and remain<br />

in his custody. A report shall periodically be made to the Board <strong>of</strong> Trustees<br />

by the Business Office <strong>of</strong> all contracts executed on behalf <strong>of</strong> the University.<br />

(c) Unless otherwise ordered by the Board <strong>of</strong> Trustees in specific cases,<br />

contracts to which the University is a party shall be signed by the Comptroller<br />

<strong>of</strong> the Board <strong>of</strong> Trustees and attested to by the Secretary <strong>of</strong> the Board <strong>of</strong><br />

Trustees, to whom authority is delegated by the Board for such purposes,<br />

provided however, that:<br />

(1) Contracts involving payments by the University in one fiscal year in<br />

excess <strong>of</strong> $2,500 shall be specifically authorized by the Board <strong>of</strong> Trustees,<br />

except that when an emergency exists the President is authorized to act but<br />

must report his action to the Board <strong>of</strong> Trustees.<br />

(2) Contracts involving major changes in University policy shall be<br />

approved specifically by the Board <strong>of</strong> Trustees.<br />

(3) Funds shall have been appropriated by the Board <strong>of</strong> Trustees, either<br />

specifically or in a general appropriation for the operation <strong>of</strong> the University,<br />

tor all contracts involving payments by the University, except those funds<br />

received from an agency outside the University and held by the University as<br />

a trustee or an agent.<br />

(4) All contracts must bear the seal <strong>of</strong> the University, which shall be in<br />

the custody <strong>of</strong> the Secretary <strong>of</strong> the Board <strong>of</strong> Trustees and shall be affixed<br />

by him.<br />

(5) Contracts for the purchase <strong>of</strong> fuel, stationery, and printing paper<br />

shall be reported to the Governor <strong>of</strong> the State <strong>of</strong> Illinois for approval, if<br />

required by the constitution or statutes <strong>of</strong> the state.<br />

(6) The Comproller and Secretary are authorized to delegate to responsible<br />

members <strong>of</strong> the staff <strong>of</strong> the University authority to execute and<br />

attest to contracts in the name <strong>of</strong> the Comptroller and the Secretary <strong>of</strong> the<br />

Board.
