Subject description<br />
Sources <strong>of</strong> law, problems with the law, the tiers <strong>of</strong> Australian<br />
Government: Commonwealth, State, Local Government. The<br />
Parliamentary Process. Constitutional constraints affecting<br />
environmental and public health legislation.<br />
Delegated legislation:<br />
(a) relevance to environmental health <strong>of</strong>ficers,<br />
(b) advantages and disadvantages,<br />
(c) reviewing through Parliament and the courts.<br />
The Australian court system, court personnel and tribunals<br />
with specialised jurisdictions. The civil and criminal trial<br />
process.<br />
Judges as a source <strong>of</strong> law - precedent and legal reasoning.<br />
Case studies <strong>of</strong> particular relevance will be examined:<br />
negligence (consumer protection); nuisance (environmental<br />
controls); and strict liability (hazardous materials).<br />
Judges as a source <strong>of</strong> law - the main judicial approaches to<br />
statutory interpretation (plain meaning or policy), the context<br />
<strong>of</strong> words in a statute, the audience, the purpose. Particular<br />
rules; meanings limited to class or association, gaps in a<br />
statute, inconsistent provisions, conflict with property rights,<br />

The purpose <strong>of</strong> this course is to provide students with a<br />
