1.8 The <strong>University</strong> will establish an appeal system<br />

through its Divisional Boards (Higher Education)<br />

and School Boards (TAFE), consistent with current<br />

appeals mechanisms within the <strong>University</strong> to<br />

ensure that student rights are protected with<br />

respect to this matter. This mechanism should<br />

allow any students to appeal against a Division's<br />

or School's credit transfer decision within the<br />

framework <strong>of</strong> the <strong>University</strong>'s credit transfer policy<br />

and principles.<br />

1.9 All Divisions will aim to ensure that the student<br />

load targets in terms <strong>of</strong> TAFE articulated<br />

enrolments are achieved by the management units<br />

consistent, in the short term, with the Pathways<br />

agreement with the State Government and, in the<br />

longer term, with DEET pr<strong>of</strong>iles plans. This will<br />

however depend on demand from students, and<br />

their level <strong>of</strong> performance and qualification.<br />

1.10 The Divisions will determine the maximum credit<br />

to be granted for their programs. In the Higher<br />

Education Divisions. Students must undertake the<br />

final two academic semesters (equivalent to one<br />

academic year) <strong>of</strong> study at the <strong>University</strong> before<br />

taking out their awards.<br />

Note: The <strong>University</strong>publishes a Credit Transfer<br />

Guide which inlcudes further information on<br />

credit transfer arrangements. Copies <strong>of</strong> the Guide<br />

are available from various <strong>of</strong>fices within the<br />

<strong>University</strong><br />

Student Disciplinary Code<br />

Computer and Network<br />

Preamble<br />

Electronic means <strong>of</strong> communication are now an intrinsic part<br />

<strong>of</strong> <strong>Swinburne</strong> <strong>University</strong> <strong>of</strong> <strong>Technology</strong>'s academic<br />

infrastructure. In order to protect the integrity and thereby<br />

maximise the academic utility to the <strong>Swinburne</strong> community <strong>of</strong><br />

the <strong>University</strong>'s electronic information systems it has become<br />

necessary to develop a student disciplinary procedure.<br />

This disciplinary code provides a mechanism for handling<br />

allegations against students <strong>of</strong> abuse in a fair and appropriate<br />

manner whilst, at the same time, providing administrators with<br />

responsible flexibility in terms <strong>of</strong> maintaining the integrity <strong>of</strong><br />

<strong>Swinburne</strong>'s electronic information systems.<br />

Implicit in this disciplinary code is the recognition that to<br />

refuse, restrict or remove a student's access to the <strong>University</strong>'s<br />

electronic information systems constitutes a serious academic<br />

penalty. As such, the disciplinary code does not assume that in<br />

every case an allegation <strong>of</strong> abuse is necessarily mischievous.<br />

With this in mind it has been designed to solve problems at the<br />

most direct level and with a view to counselling a student(s), in<br />

the first instance, on the appropriate use <strong>of</strong> <strong>Swinburne</strong>'s<br />

electronic information systems.<br />

It should be <strong>note</strong>d that whilst the preamble has been framed<br />

to broadly cover the <strong>University</strong>'s electronic information systems<br />

in general, the student disciplinary code that follows is, for the<br />

present, more specific is in its scope. As such it is to be<br />

regarded as an interim and shall apply only as a breach to the<br />

<strong>University</strong>'s Network Access and Code <strong>of</strong> Practice.<br />

Application <strong>of</strong> computer and network<br />

student disciplinary code<br />

1.1 The Computer and Network Student Disciplinary<br />

Code ('Disciplinary Code') shall be regarded as<br />

interim and until otherwise be proclaimed by the<br />

<strong>University</strong> shall apply only in respect <strong>of</strong> a breach<br />

by a student <strong>of</strong> the <strong>University</strong>'s Network Access<br />

and Code <strong>of</strong> Practice Policy ('The Code <strong>of</strong><br />

Practice').<br />

1.2 For the purposes <strong>of</strong> section 15 <strong>of</strong> the Network<br />

Access and Code <strong>of</strong> Practice any reference to due<br />

process, whether it involves a decision to refer a<br />

breach <strong>of</strong> 'The Code <strong>of</strong> Practice' to a student<br />

disciplinary committee or otherwise, shall be<br />

deemed as a reference to the Disciplinary Code.<br />

1.3 It is the responsibility <strong>of</strong> the <strong>University</strong> to ensure<br />

that both 'The Code <strong>of</strong> Practice' and the<br />

Disciplinary Code are widely available to students,<br />

both in hard copy and electronic form. The<br />

<strong>University</strong> shall ensure that 'The Code <strong>of</strong> Practice'<br />

and the Disciplinary Code are published in the<br />

<strong>Swinburne</strong> Handbook.<br />

2. Counselling Procedure<br />

2.1 If a breach <strong>of</strong> 'The Code <strong>of</strong> Practice' is detected<br />

involving a student, the matter will be referred to<br />

the Manager, Computer Services and Information<br />

<strong>Technology</strong>, or nominee, who shall, in the first<br />

instance, counsel the user(s) in a manner that<br />

ensures the user(s) is aware <strong>of</strong> the Network Access<br />

and Code <strong>of</strong> Practice, its purpose, the nature <strong>of</strong><br />

the breach, why their actions were inappropriate<br />

and the consequences <strong>of</strong> further breaches. This<br />

counselling session shall be regarded as a warning<br />

and shall be delivered without prejudice to the<br />

access rights <strong>of</strong> the user(s).<br />

a) The Manager, Computer Services and<br />

lnformation <strong>Technology</strong> shall ensure that a<br />

written record <strong>of</strong> the student counselling<br />

session is made. This record will be retained<br />

for one year from the date counselling took<br />

place, after which time the record will be<br />

destroyed.<br />

2.2 If the user(s) persists with the action for which he/<br />

she has already been warned, or breaches 'The<br />

Code <strong>of</strong> Practice' again the Manager, Computer<br />

Services and lnformation <strong>Technology</strong> shall, at his/<br />

her discretion, enact the Network Disciplinary<br />

Procedure.<br />

2.3 If the Manager, Computer Services and<br />

lnformation <strong>Technology</strong>, or nominee, forms the<br />

view that the breach for which the student has<br />

been referred for counselling is major, s/he may, at<br />

hidher discretion, either:<br />

a) Proceed with the counselling procedure in<br />

accordance with section 2.1;<br />

or<br />

b) In addition to counselling the student, enact<br />

the Network Disciolinarv Procedure. The<br />

process for initiatihq thk procedure shall,<br />

except where otherwise stated, be in<br />

accordance with section 3.2.
