7.6.3 Action<br />
a) After any meeting <strong>of</strong> the Examination<br />
Conduct Committee. the Academic<br />
Registrar will advise the student within<br />
three working days <strong>of</strong> the Committee's<br />
decision and the penalty, if any, which<br />
has been imposed.<br />
b) The statement must also contain the<br />
Committee's reasons and detail relevant<br />
appeal mechanisms.<br />
8. Assessment Conduct Enquiry<br />
8.1 When an irregularity is suspected in an<br />
assignment, essay, examination or other piece <strong>of</strong><br />
work for assessment which is not under the<br />
control <strong>of</strong> the Academic Registrar as defined<br />
above, the member <strong>of</strong> staff who detects the<br />
apparent irregularity will inform the Chief<br />
Examiner, the Subject Convener and the Head <strong>of</strong><br />
School as soon as the irregularity is identified.<br />
8.2 The Chief Examiner will assess whether or not<br />
there is prima facie evidence to suggest there has<br />
been an irregularity. If it is the belief <strong>of</strong> the Chief<br />
Examiner that there may have been an irregularity<br />
a meeting <strong>of</strong> the Assessment Conduct Committee<br />
will be convened to investigate the matter:<br />
8.3 Assessment Conduct Committee<br />
8.3.1 The Assessment Conduct Committee shall<br />
consist <strong>of</strong>:<br />
a) the Head <strong>of</strong> the awarding Division<br />
(Chair), or nominee;<br />
b) the Head <strong>of</strong> the School;<br />
c) the Subject Convener; and<br />
d) the President <strong>of</strong> the Student Union or<br />
nominee.<br />
8.3.2 If the Committee as convened according to<br />
sections 8.3 and 8.3.1 is <strong>of</strong> the view by a<br />
majority vote that an irregularity has<br />
occurred, the Committee may, taking into<br />
account the seriousness <strong>of</strong> the occurrence<br />
and circumstances, decide:<br />
a) to take no action;<br />
b) to reprimand the student;<br />
c) that particular questions in the<br />
assignment, essay or other piece <strong>of</strong><br />
work be not marked;<br />
d) that the assignment, essay or other<br />
piece <strong>of</strong> work be cancelled;<br />
e) that the assignment, essay or other<br />
piece <strong>of</strong> work be not marked and a fail<br />
result be recorded;<br />
f) to suspend the student from the<br />
<strong>University</strong> for a period <strong>of</strong> time (up to<br />
two semesters);<br />
g) that the student be suspended from<br />
further study from the course for a<br />
maximum <strong>of</strong> two years;<br />
h) that the student be excluded from<br />
further study in the course. Such<br />
students wishing to re-enter, may apply<br />
for re-admission to the course after a<br />
minimum <strong>of</strong> two years; or,<br />
i) to recommend to the Vice-Chancellor<br />
that the student be excluded from<br />
further study in the <strong>University</strong>. Such<br />
students wishing to re-enter, may apply<br />
for re-admission to the university after<br />
the period <strong>of</strong> exclusion.<br />
8.3.3 Action<br />
a) after any meeting <strong>of</strong> the Assessment<br />

9. Appeals<br />
A student shall have the right <strong>of</strong> appeal against the decision<br />
andlor the penalty imposed under sections 7.6 and 8. A<br />
written appeal must be lodged with the Academic Registrar<br />
within ten working days <strong>of</strong> the student being notified <strong>of</strong> the<br />
penalty imposed. The appeal will be heard by an Appeals<br />
Committee constituted for the purpose.<br />
9.1 Examination and Assessment Conduct Appeals<br />
Committee<br />
9.1 .I The Appeals Committee shall consist <strong>of</strong>:<br />
a) a Chair nominated by the Chair <strong>of</strong> the<br />
Academic Board;<br />
b) the President <strong>of</strong> the Student Union, or<br />
nominee;<br />
C) one member <strong>of</strong> the academic staff <strong>of</strong><br />
the Higher Education Divisions <strong>of</strong> the<br />
<strong>University</strong> selected by the Chair,<br />
Academic Board, from a School other<br />
than that in which the student has been<br />
taught; provided that no member <strong>of</strong> the<br />
Appeals Committee shall have been a<br />
party to the original investigation.<br />
The Chair <strong>of</strong> the original committee,<br />
and the Subject Convener, must be<br />
given the opportunity to appear during<br />
the course <strong>of</strong> the hearing.<br />
The student concerned and/or hidher<br />
advocate may address the Committee<br />
and provide such information and call<br />
such others as the Committee may<br />
agree. The advocate may not also be a<br />
member <strong>of</strong> the Committee.<br />
9.2 Powers <strong>of</strong> the Examination and Assessment<br />
Conduct Appeals Committee<br />
9.2.1 The actions available to the Committee<br />
shall include:<br />
a) find the decision <strong>of</strong> the relevant<br />
Conduct Committee proved and allow<br />
the penalty imposed by that committee<br />
to stand;<br />
b) find the decision <strong>of</strong> the relevant<br />
Conduct Committee proved but modify<br />
the penalty, if in the circumstances, it is<br />
deemed to be too harsh;
