17.8 The Appeals Committee shall investigate the issue<br />
in the following manner:<br />
17.8.1 The Committee will meet within seven<br />
working days <strong>of</strong> the date the appeal is<br />
made to the Academic Registrar. It will<br />
consider all written documentation<br />
includina the written statements <strong>of</strong> the<br />
student and staff member and the written<br />
statement <strong>of</strong> any witnesses.<br />
17.8.2 The Committee may call before it the<br />
student and other parties considered<br />
appropriate by the Committee.<br />
17.8.3 committee decisions should be reached<br />
through a majority vote or by agreement<br />
between the members, all <strong>of</strong> whom have<br />
equal voting rights.<br />
17.9 Actions available to Assessment Appeal<br />
Committee<br />
The actions available to the Assessment Appeal<br />
Committee shall include: 18.2<br />
a) dismissing the case,<br />
b) upholding the case, and c) or d) ore) as<br />
applicable:<br />
c) allowing the student to re-sit a formal<br />
examination or submit further written work<br />
d) reparation to the student for loss <strong>of</strong> any<br />
academic credit or achievement<br />
e) recommend to the Head <strong>of</strong> School (or Pro Vice-<br />
Chancellor) to discuss aspects <strong>of</strong> the appeal<br />
with the staff member concerned.<br />
7 18. Exclusions Appeal<br />
0 n<br />
A student who has been excluded by a Division for<br />
unsatisfactory progress has a right to appeal against that<br />
W decision. Such appeals must be lodged in writing with the<br />
Academic Registrar within ten working days <strong>of</strong> the date <strong>of</strong> the<br />
letter advising the student <strong>of</strong> the exclusion. Appeals will be 19.1<br />
a<br />
heard according to the procedures detailed below.<br />
18.1 Exclusions Appeal Committee<br />
All appeals will be presented to the Exclusions<br />
Appeals Committee.<br />
18.1 .I The Committee will comprise:<br />
a) the Vice-Chancellor's nominee from<br />
within the Chancellery who will act as<br />
Chair;<br />
b) a representative <strong>of</strong> the Student Union 19.2<br />
nominated by the President <strong>of</strong> the<br />
Union; and<br />
C) a member <strong>of</strong> the academic staff <strong>of</strong> the 19.3<br />
Higher Education Divisions <strong>of</strong> the<br />
<strong>University</strong> chosen by the Chair <strong>of</strong><br />
Academic Board. The person so chosen<br />
shall not be from the Division<br />
concerned. 19.4<br />
The Academic Registrar (or nominee)<br />
will attend and act as Secretary.<br />
18.1.2 The student or a representative <strong>of</strong> the<br />
Division may submit any other written 19.5<br />
material to the Committee in support <strong>of</strong><br />
their case. Any additional evidence so<br />
provided shall be copied to the other party<br />
or parties in the appeal.<br />
18.1.3 The student and a representative <strong>of</strong> the<br />
Division separately must be given the<br />
opportunity to appear during the course <strong>of</strong><br />
the hearing.<br />
18.1.4 Students invited to attend a meeting <strong>of</strong> the<br />
Committee, may be represented by an<br />
advocate who may not be a member <strong>of</strong> the<br />
Appeals Committee.<br />
18.1.5 Upon a hearing under Section 16 the<br />
Exclusions Appeals Committee may:<br />
a) confirm the exclusion or condition in<br />
respect <strong>of</strong> which the application was<br />
made; or<br />
b) uphold the appeal and re-admit the<br />
student to the course from which the<br />
student was excluded; the Committee<br />
may, depending on the circumstances <strong>of</strong><br />
the case, impose conditions, upon the<br />
enrolment <strong>of</strong> the applicant to the<br />
<strong>University</strong>.<br />
Exclusions Appeals Procedure<br />
The Exclusions Appeals Committee will investigate<br />
the issue in the following manner.<br />
18.2.1 The Committee will meet within seven<br />
working days <strong>of</strong> the date the formal appeal<br />
is made to the Academic Registrar. It will<br />
consider all written documentation<br />
including the written statements <strong>of</strong> the<br />
student and staff member and the written<br />
statement <strong>of</strong> any witnesses.<br />
18.2.2 The Committee may call before it the<br />
student and other parties considered<br />
appropriate by the committee.<br />
18.2.3 Committee decisions should be reached by<br />
a majority vote.<br />
19. Procedures for other academic issues<br />
Where a student has an issue other than about an<br />
assessment grade or an exclusion there should be<br />
an initial contact with the relevant staff member at<br />
a level consistent to the complaint. In the case<br />
where the issue involves a member <strong>of</strong> staff,<br />
discussion should be held with the Head <strong>of</strong> School.<br />
In the case where the issue involves the Head <strong>of</strong><br />
School, the School or Division, discussions should<br />
be held with the Pro Vice-Chancellor. Wherever<br />
possible issues should be dealt with informally.<br />
If no resolution is reached the student shall make<br />
a written submission to the Head <strong>of</strong> School briefly<br />
outlining the case.<br />
If the Head <strong>of</strong> School is the subject <strong>of</strong> or<br />
associated with the matter, or where the matter<br />
concerns the Department (School) itself, the<br />
student may submit a case to the Pro Vice-<br />
Chancellor <strong>of</strong> the Division.<br />
The Head <strong>of</strong> School (or Pro Vice-Chancellor) will<br />
meet, within seven working days, with the student<br />
(or representatives <strong>of</strong> the group <strong>of</strong> students) in an<br />
attempt to clarify and resolve the issue.<br />
With the agreement <strong>of</strong> the student, the Head <strong>of</strong><br />
School (or Pro Vice-Chancellor) will meet<br />
informally with the appropriate member(s) <strong>of</strong> staff<br />
concerned with the issue and submit in writing to<br />
the staff member(s) concerned and the Pro Vice-<br />
Chancellor, details <strong>of</strong> the meeting and the<br />
outcome.
