28 MANUEL ATIENZA En un análisis de los razonamientos jurídicos, Klug no tiene en cuenta, sin embargo, la lógica deóntica o lógica de las normas. Esta última disciplina se desarrolla también a partir de 1951 (año en que aparece el ensayo de George H. Von Wright, Deontic Logic) y lleva a concebir la lógica jurídica —bien en cuanto lógica del derecho, o bien en cuanto lógica de los juristas— no como una aplicación de la lógica formal general al campo del derecho, sino como una lógica especial, elaborada a partir de las modalidades deónticas de obligación, prohibición y permisión. Estos operadores deónticos pueden, pues, utilizarse —como lo hemos hecho anteriormente- para dar cuenta de los razonamientos jurídicos o de algunos de ellos. Veamos, brevemente, cómo se plantea esta tarea un autor como Kalinowski, que ha sido también uno de los fundadores de la lógica deóntica. Kalinowski (1973) considera como razonamientos jurídicos aquellos que vienen exigidos por la vida jurídica, y presenta de ellos una doble clasificación. Por un lado, distingue entre razonamientos de coacción intelectual (lógicos), de persuasión (retóricos) y propiamente jurídicos (los que se basan en presunciones, prescripciones, ficciones, etc., establecidas por la ley). Por otro lado, separa los razonamientos normativos (cuando al menos una de las premisas y la conclusión son normas) de los no normativos (que sólo serían jurídicos por accidente). Los razonamientos normativos, por su lado, pueden tener lugar en el plano de la elaboración, de la interpretación o de la aplicación del derecho. en concreto, en el plano de la interpretación del derecho se utilizan tanto argumentos extralógicos, que se basan en medios puramente jurídicos (por ejemplo, el argumento a rubrica, pro subjecta materia, etc.), como argumentos paralógicos, que se basan en técnicas retóricas (por ejemplo, el argumento ab auctoritate, a generali sensu, ratione legis estricta, etc.) y argumentos lógicos, que se basan en la lógica formal propiamente dicha (por ejemplo, argumentos a fortiori, a maiori, a pari y a contrario). Los argumentos estrictamente lógicos están regidos, sin embargo, tanto por reglas lógicas en sentido estricto (las de la lógica deóntica forman parte de la lógica formal deductiva) como por reglas extralógicas, esto es, por reglas jurídicas de interpretación del derecho. Además, Kalinowski considera que el primer tipo de reglas están subordinadas a las segundas, lo que podría entenderse en el sentido de que la justificación interna depende de la justificación externa o es un momento lógicamente posterior al de esta.
