CHAPTER 4GENERAL PROVISIONSARTICLE 85List of arbitrators1. The EPA Committee shall, no later than six months after this Agreem<strong>en</strong>t's <strong>en</strong>try into force,establish a list of 15 individuals who are willing and able to serve as arbitrators. Each of the Partiesshall select five individuals to serve as arbitrators. The two Parties shall also agree onfive individuals who are not nationals of either Party and who may be called upon to act aschairperson to the arbitration panel. The EPA Committee shall <strong>en</strong>sure that a full list is alwaysmaintained.2. Arbitrators shall have specialised knowledge or experi<strong>en</strong>ce of law and international trade.They shall be indep<strong>en</strong>d<strong>en</strong>t, serve in their individual capacities and not take instructions from anyorganisation or governm<strong>en</strong>t or be affiliated with the governm<strong>en</strong>t of any of the Parties, and shallcomply with the code of conduct adopted by the EPA Committee.3. The EPA Committee may draw up an additional list of 15 individuals with sectoral expertisein specific matters covered by the Agreem<strong>en</strong>t. Where recourse is made to the selection procedureunder Article 71(2), the chairperson of the EPA Committee may use this type of sectoral list withthe agreem<strong>en</strong>t of both Parties.<strong>CE</strong>/<strong>PAC</strong>/<strong>en</strong> 88
