(6) If the beneficiary is still receiving student benefits on turning 23, compensation<br />

should terminate at the end <strong>of</strong> that semester or enrollment period.<br />

(7) Following are examples <strong>of</strong> common situations:<br />

(a) John Smith's birth date is February 10, 1977. He has received compensation<br />

since 1983, and he will graduate from high school in May 1994. John has completed<br />

Form CA-1615 to indicate that he will attend college on a full-time basis starting in<br />

the fall <strong>of</strong> 1994. John's first "year <strong>of</strong> education beyond the high school level" will<br />

begin in June 1994, even though he is still entitled to benefits by virtue <strong>of</strong> being<br />

under 18 until February 1995.<br />

(b) Steve Jones' date <strong>of</strong> birth is January 13, 1976. He received compensation<br />

beginning in 1984 and graduated from high school in June 1994. He completed<br />

Form CA-1615 to indicate that he would not attend college. He was entitled to<br />

receive compensation through June 1994, the month <strong>of</strong> his high school graduation<br />

(he was 18 when he graduated). Should Steve decide at some future date to<br />

continue his education, he would begin receiving compensation the month that he<br />

actually entered school and would be entitled to the entire four years <strong>of</strong> eligibility<br />

until he turns 23.<br />

(c) Jane Doe's date <strong>of</strong> birth is April 15, 1974, and she received compensation<br />

beginning in 1988. She graduated from high school in May 1992 and indicated on<br />

Form CA-1615 that she would continue her education in the fall. Because <strong>of</strong> this<br />

evidence <strong>of</strong> a bona fide intent to attend school, her compensation was continued<br />

over the summer. In September she advised OWCP that she had reconsidered and<br />

decided to work instead <strong>of</strong> attending school.<br />
