(b) If the refusal is not found to be reasonable or justified (or the claimant does<br />

not respond within the 30-day period), a formal decision terminating entitlement to<br />

both COP and compensation is to be issued. Termination <strong>of</strong> entitlement is effective<br />

the date the agency terminated COP rather than the date <strong>of</strong> the formal decision.<br />

The date <strong>of</strong> the agency's termination <strong>of</strong> COP should be the date the job was available<br />

to the employee.<br />

(3) If the employing agency has terminated COP based on the employee's refusal <strong>of</strong> an<br />

<strong>of</strong>fer <strong>of</strong> suitable work but the written job <strong>of</strong>fer (including the description and physical<br />

requirements <strong>of</strong> the job) is not received prior to or with Form CA-7, compensation should be<br />

initiated as claimed. Once initiated, compensation should continue, as appropriate, until a<br />

final determination is made concerning the refusal <strong>of</strong> the <strong>of</strong>fered work.<br />

(4) If it is determined subsequently that the refusal was not reasonable, a formal<br />

decision should be issued which denies COP as <strong>of</strong> the date the agency terminated pay (since<br />

the agency's action was proper) and terminates the employee's entitlement to<br />

compensation as <strong>of</strong> the beginning date <strong>of</strong> the next periodic roll cycle.<br />

If payment was made on the daily roll, the date <strong>of</strong> termination should be the date <strong>of</strong> the employee's<br />

refusal (or, if the employee did not respond, the end <strong>of</strong> the 30-day period allowed for response),<br />

provided compensation has not been paid beyond that date. If compensation has been paid beyond that<br />

date, it should be terminated as <strong>of</strong> the end <strong>of</strong> the last period for which payment was made.<br />

2-0807-17 Timely Payment <strong>of</strong> Compensation<br />

17. Timely Payment <strong>of</strong> Compensation. In order to ensure that claimants are not without income during<br />

the period immediately following payment <strong>of</strong> continuation <strong>of</strong> pay, the CE must advise claimants and<br />

employing agencies promptly <strong>of</strong> actions needed to claim compensation and process any claims on file.<br />

a. Notification <strong>of</strong> Employee. When a traumatic injury case is accepted, the CE may notify the<br />

claimant <strong>of</strong> the acceptance, with a copy to the agency. Such notification must be provided in all<br />

cases in which the employing agency has controverted the claim and should include an explanation<br />

(see paragraph 10.c above). Notification need not be provided in the following situations:<br />

(1) The claim for compensation is received prior to acceptance <strong>of</strong> the case.<br />

(2) No time has been lost beyond the date <strong>of</strong> injury.<br />

(3) Form CA-1 shows that the claimant returned to duty prior to the expiration <strong>of</strong> the COP<br />

period.<br />

(4) The medical evidence clearly establishes that the employee will return to work before the<br />

45th day.<br />

The claimant is primarily responsible for submitting medical evidence and claims for compensation.<br />

The Office is not obligated to continue paying compensation where no further claim is made and no<br />

medical evidence demonstrating continued disability appears in file.<br />
