d. Cooperative Agreement. The title <strong>of</strong> the job, the job duties, the salary to be paid, and the<br />

wage subsidy rate will all be specified in a cooperative agreement. The District Director must<br />

approve the cooperative agreement between the OWCP and the new employer. The employer's<br />

representative will also sign the cooperative agreement.<br />

e. Concurrence <strong>of</strong> CE. The CE must concur, in the form <strong>of</strong> a memorandum, with the<br />

cooperative agreement. The CE should attach the memorandum <strong>of</strong> concurrence to the cooperative<br />

agreement and forward it to the District Director for approval after ensuring that the job <strong>of</strong>fer:<br />

(1) Is in writing;<br />

(2) Conforms to the claimant's work limitations and is suitable within the meaning <strong>of</strong><br />

Section 8106 (c); and<br />

(3) Supports an LWEC rating, i.e., the earnings must fairly and reasonably represent the<br />

claimant's wage-earning capacity.<br />

f. Payment <strong>of</strong> Compensation.<br />

(1) To eliminate the possibility <strong>of</strong> an overpayment, the CE should remove the case from<br />

the periodic roll as soon as the beginning date <strong>of</strong> work is known.<br />

(2) Any additional entitlement to compensation on the basis <strong>of</strong> temporary total disability<br />

(TTD) should be paid on the daily roll until the employment commences.<br />
