2-0812-6 Medical Elements <strong>of</strong> Review<br />

6. Medical Elements <strong>of</strong> Review. Medical evidence should be obtained in accordance with the case<br />

status, as noted in paragraph 5 above, in order to determine the progress <strong>of</strong> the employment-related<br />

condition and the extent <strong>of</strong> impairment resulting from this condition.<br />

General procedures for obtaining medical evidence are contained in <strong>FECA</strong> PM 2-0810. Where adequate<br />

medical reports are not received at intervals reasonable to the particular case, it is the CE's responsibility<br />

to obtain them or to make an appropriate referral using the authority provided in 5 U.S.C. 8123.<br />

The CE may contact the physician directly, with a copy to the claimant, to obtain medical evidence<br />

containing the information shown below. Alternatively, the CE may write directly to the claimant and<br />

advise that current medical evidence must be submitted to support continuing payment <strong>of</strong> benefits. The<br />

claimant need not be examined if the physician can provide the requested information from his or her<br />

records and an examination has occurred since the last periodic roll review as described in paragraph 5<br />

above.<br />

If appropriate, specific questions should be addressed to the physician regarding whether a temporary<br />

aggravation has resolved or whether the aggravation has caused a material change in the<br />

pre-existing/underlying condition; whether the claimant's physical condition permits a return to the job<br />

held at time <strong>of</strong> injury or to a restrictive position; or whether the claimant would be a candidate for<br />

vocational rehabilitation. A copy <strong>of</strong> a current and accurate SOAF should be enclosed if it would assist the<br />

physician with providing a response.<br />

a. Content <strong>of</strong> Medical Reports. Regardless <strong>of</strong> whether the CE contacts the physician or the<br />

claimant, the medical report should include:<br />

(1) The date <strong>of</strong> most recent examination.<br />

(2) Results <strong>of</strong> recent objective testing.<br />

(3) Physical examination findings.<br />

(4) The diagnosis <strong>of</strong> any conditions present.<br />

(5) A well reasoned medical opinion supported by the physical findings and objective<br />

testing as to whether the current condition(s) is related to the employment.<br />

(6) The claimant's work restrictions, including a completed Form OWCP-5 if applicable.<br />

(7) The type and frequency <strong>of</strong> medical treatment being provided or recommended.<br />

b. Follow Up Actions.<br />

(1) If sufficient medical evidence is in file, the CE should review the reports to determine<br />
