(3) In death cases, <strong>FECA</strong> benefits will be reduced by the survivor's benefits paid under<br />

the Social Security Act attributable to the employee's Federal service.<br />

5. Obtaining Elections Between OWCP and OPM Benefits.<br />

a. In all death cases, and in disability cases where the record indicates that a claim has been<br />

made for benefits under CSRS or FERS, the CE should release Form CA-1101 to OPM during initial<br />

development <strong>of</strong> the claim. This request should help to ensure that the necessary information about<br />

the status <strong>of</strong> the claim for annuity is in file when entitlement to <strong>FECA</strong> benefits is determined. If the<br />

initial response from OPM is negative, but some time elapses before entitlement to <strong>FECA</strong> benefits is<br />

determined, the CE should make further inquiry to OPM before <strong>FECA</strong> benefits are paid if there is<br />

any reason to believe that a claim for OPM benefits was later made.<br />

b. When an election is required in a disability case, the CE will release Form CA-1102 to the<br />

employee, with copies to all parties in interest. This letter provides information about the rate <strong>of</strong><br />

compensation payable and the employee's right to elect the more advantageous benefit. Two<br />

copies <strong>of</strong> Form CA-1105, Election <strong>of</strong> Benefits, should accompany Form CA-1102.<br />

(1) Pay Rates. The monthly rate <strong>of</strong> the compensation entitlement should be shown on<br />

Form CA-1102, so that the employee may compare the two benefits easily. The<br />

four-weekly rate should also be indicated.<br />

(2) Retroactive Payment. When the claimant is entitled to retroactive compensation and<br />

CPIs are applicable, the form should show the amount payable for each period from the<br />

beginning <strong>of</strong> entitlement to the present.<br />
