personally intervene with the claimant before the 90th day to discuss the need to agree on a plan.<br />

The RS will advise the CE when an extension in PD is proper. The RS and CE will discuss any<br />

extension in PD which will affect notification <strong>of</strong> the claimant within one year. The CE should advise<br />

the RS when PD activity should resume (e.g., if suspended for medical reasons).<br />

c. CE Actions. The RS will advise the CE once a viable plan is received.<br />

(1) The CE must ensure that the medical requirements <strong>of</strong> the job are consistent with the<br />

weight <strong>of</strong> medical evidence and must be prepared to explain its suitability to the claimant<br />

(see paragraph c(2) below).<br />

(a) If the CE has any questions, he or she should contact the RS. For instance,<br />

the CE may ask why a plan which seems very expensive or lengthy was chosen over<br />

other available alternatives, and discuss these alternatives with the RS. However, it<br />

is not the CE's role to assess the vocational aspect <strong>of</strong> the plan.<br />

(b) The CE should address such issues to the RS within one week <strong>of</strong> receiving the<br />

plan. After that time, absent any questions, the RS will advise the RC to proceed.<br />

(2) The RC may discuss the motivation <strong>of</strong> the claimant to undertake a training program.<br />

If the earnings <strong>of</strong> the job for which the claimant is being retrained will greatly increase his<br />

or her WEC, but the claimant is reluctant to undertake the program, the CE will need to<br />

remind him or her <strong>of</strong> the need to cooperate with vocational rehabilitation efforts.<br />

(3) After reviewing the plan, the CE will advise the claimant that:<br />

(a) Based on a thorough vocational evaluation and a survey <strong>of</strong> the local labor<br />

market, he or she has a wage-earning capacity <strong>of</strong> a specific dollar amount (as stated<br />

by the RC) which will determine future compensation entitlement;<br />

(b) He or she is expected to return to work in a job similar to the one identified,<br />

and that only partial compensation based on the above-stated wage-earning capacity<br />

will be paid at the end <strong>of</strong> this effort;<br />
