2-0900-11 Computing Monthly Pay Rate<br />

11. Computing Monthly Pay Rate. This paragraph describes how to compute a monthly pay rate, which<br />

is used in death cases. To do so, the CE must first determine the employee's "average annual earnings"<br />

in the manner provided by Section 5 U.S.C. 8114(d) and the instructions appearing in paragraph 4 above.<br />

This figure is then divided by 12.<br />

2-0900-12 Special Determinations<br />

12. Special Determinations. This paragraph defines the rules for determining pay rates based on<br />

unusual terms <strong>of</strong> employment, pay scales, or increments <strong>of</strong> pay.<br />

a. Minors. Section 5 U.S.C. 8113(a) states that:<br />

If an individual (1) was a minor or employed in a learner's capacity at the time <strong>of</strong> injury;<br />

and (2) was not physically or mentally handicapped before the injury; the Secretary <strong>of</strong><br />

Labor...after the time the wage-earning capacity <strong>of</strong> the individual would probably have<br />

increased but for the injury, shall recompute prospectively the monetary compensation<br />

payable for disability on the basis <strong>of</strong> an assumed monthly pay corresponding to the probable<br />

increased wage-earning capacity.<br />

The <strong>FECA</strong> does not define the term "minor", and whether a person has attained his or her majority<br />

must be determined under state law <strong>of</strong> the claimant's domicile. Since the interpretation <strong>of</strong> state<br />

laws and judicial decisions is involved, any case where this issue arises should be referred to the<br />

<strong>National</strong> Office for a determination.<br />

b. Cadets at Federal and State Maritime Academies. Cadets at Federal and State Maritime<br />

Academies do not receive wages while in training, but they are provided with a monthly allowance<br />

for subsistence, quarters, etc. This sum will serve as the basis for computing compensation.<br />

However, cadets are working in learners' capacities and the pay rate may be recomputed according<br />

to the provisions <strong>of</strong> Section 8113(a) where appropriate.<br />

c. Peace Corps Volunteers, Volunteers in Service to America (VISTA) and Job Corps Enrollees.<br />

(See also <strong>FECA</strong> PM 2-1700.4 through 6.) Entitlement to compensation for these groups <strong>of</strong><br />

employees does not begin until the volunteers or enrollees are separated from their employment.<br />

The pay rate to be used is the one in effect at the time <strong>of</strong> separation.<br />

(1) For Peace Corps Volunteers, the pay rate is set at the GS-7, step 1 level, and for<br />

Peace Corps Leaders, it is set at the GS-11, step 1 level. For injuries on or after September<br />

7, 1974, the pay rate <strong>of</strong> Peace Corps Volunteers designated as "heads <strong>of</strong> households" is set<br />

at the GS-11 rate. Locality pay is not included.<br />

(2) For VISTA Volunteers injured on or after October 1, 1993, the pay rate is set at the<br />

GS-5, step 1 level. (Before that time, the pay rate was set at the GS-7, step 1 level.); or<br />

(3) For Job Corps enrollees, the pay rate is set at the GS-2, step 1 level.<br />

d. Department <strong>of</strong> Agriculture--Cooperative Employees. For a person working with the<br />

Department <strong>of</strong> Agriculture under a cooperative agreement with a non-Federal public or private<br />
