2-1400 Exhibit 2: Sample <strong>Letter</strong> Conveying Proposed Termination<br />

Dear CLAIMANT NAME:<br />

Under the provisions <strong>of</strong> the Federal Employees' Compensation Act (5 U.S.C. 8101 et seq.) and the<br />

program's regulations (20 C.F.R. 10.1 et seq.), we propose to terminate your compensation payments for<br />

wage loss on account <strong>of</strong> the injury identified above. The basis for this action is described in the Notice <strong>of</strong><br />

Proposed Decision dated May 10, 1996, a copy <strong>of</strong> which is enclosed. Also enclosed is a copy <strong>of</strong> the report<br />

<strong>of</strong> Dr. William Jones dated April 4, 1996, which serves as the basis for the proposed termination.<br />

If you disagree with the proposed action, you may submit additional evidence or argument relevant to the<br />

issue described in the Notice.<br />

Send any such evidence or argument to this <strong>of</strong>fice within 30 days <strong>of</strong> the date <strong>of</strong> this letter. We will not<br />

terminate your compensation during this 30-day period, but if no response is received within 30 days, we<br />

will terminate your compensation at that time.<br />

Under the regulations <strong>of</strong> the Office <strong>of</strong> Personal Management (OPM), an employee who recovers from a<br />

compensable injury within one year is entitled to be restored to the job held when injured, or equivalent.<br />

Such an employee is expected to apply for reemployment with his or her agency immediately upon<br />

recovery. An employee who takes more than one year to recover is entitled to priority consideration,<br />

provided he or she applies for reemployment within 30 days after compensation ends.<br />

You may obtain further information about these rights from your agency or the OPM. You may also wish<br />

to contact your agency or the OPM for advice on continuing any health insurance and/or life insurance<br />

coverage you may have.<br />
