eceived within 30 days, interest shall accrue as <strong>of</strong> the date <strong>of</strong> the initial demand letter. If<br />

payment is not received on such case, a second letter will be released notifying the claimant that<br />

the debt remains outstanding and that entitlement to compensation is subject to suspension for<br />

failure to satisfy the debt. The computer record will be updated to reflect the fact that the debt<br />

remains unpaid. If a claim for further benefits is received prior to the payment <strong>of</strong> the debt, the CE<br />

should consider whether to issue a formal decision suspending or forfeiting entitlement to benefits,<br />

under 20 C.F.R. §10.708.<br />

Pursuant to 20 C.F.R. § 10.715, interest shall accrue, at the U.S. Treasury rate (Current Value <strong>of</strong><br />

Funds), on the refund due to the United States from the date <strong>of</strong> the request, if the refund is not<br />

submitted in full within 30 days <strong>of</strong> the receipt <strong>of</strong> the request for payment. OWCP or SOL may<br />

waive the collection <strong>of</strong> interest in accordance with 29 C.F.R. § 20.61.<br />

b. SOL Responsibility for Debt Collection in Referred Cases.<br />

(1) For referred cases, FEEWC should advise the claimant and/or the attorney that a<br />

debt is owed to the United States, and make an initial demand for payment <strong>of</strong> this debt.<br />

The initial demand letter must notify the debtor <strong>of</strong>:<br />

(a) The basis for the debt;<br />

(b) The applicable standards for imposing interest, penalties, or administrative<br />

costs;<br />

(c) The date by which payment should be made;<br />

(d) The name, address, and telephone number <strong>of</strong> a contact person or <strong>of</strong>fice<br />

within the agency;<br />

(e) That the debtor may enter into a mutually agreeable written repayment<br />

agreement; and<br />

(f) That the debtor may make a written request for a review <strong>of</strong> the<br />

determinations regarding the amount <strong>of</strong> the debt, its past-due status, and its legal<br />

enforceability.<br />
