(2) Staff Spouses.<br />

(a) The spouses <strong>of</strong> Peace Corps staff members serving in foreign countries have<br />

the protection <strong>of</strong> the <strong>FECA</strong> while performing service or engaged in <strong>of</strong>ficial travel in<br />

keeping with the terms <strong>of</strong> PECTO CA-39, an airgram issued by the Peace Corps on<br />

April 23, 1964. In addition to Form CA-1 or CA-2, a copy <strong>of</strong> the travel authorization<br />

and the information outlined in Form CA-1014 will be required. Performance <strong>of</strong> duty<br />

will be determined on a case-by-case basis. The pay rate for computing<br />

compensation will be determined in the manner used for persons coming within the<br />

scope <strong>of</strong> section 8101(1)(B) <strong>of</strong> the <strong>FECA</strong>.<br />

(3) Staff Employees. These employees fall within the definition <strong>of</strong> "employee" outlined<br />

in 5 U.S.C. 8101(1). They have full coverage <strong>of</strong> the <strong>FECA</strong>, and their claims are adjudicated<br />

in the district <strong>of</strong>fice having jurisdiction over the place <strong>of</strong> employment. See <strong>FECA</strong> PM<br />

1-100.4.<br />

c. Conditions <strong>of</strong> Coverage.<br />

(1) Training Period.<br />

(a) All applicants for enrollment as volunteers undergo training prior to actual<br />

enrollment. The Peace Corps provides this training at designated universities or<br />

training centers. In keeping with section 8(a) <strong>of</strong> the Peace Corps Act, applicants<br />

have the protection <strong>of</strong> the <strong>FECA</strong> while performing their training assignments or while<br />

engaged in any activity which is a reasonable incident <strong>of</strong> the training assignment.<br />

(b) The trainees receive subsistence and quarters while in training, and<br />

transportation to and from the training sites. For this reason, their coverage under<br />

the <strong>FECA</strong> will include many activities other than the specific training functions.<br />

Requirements for pro<strong>of</strong> <strong>of</strong> "performance <strong>of</strong> duty" or "causal relation" will be the same<br />

as that required in the case <strong>of</strong> a Federal employee.<br />

(2) Serving Abroad.<br />

(a) In keeping with section 5(d)(2) <strong>of</strong> the Peace Corps Act, injuries <strong>of</strong> trainees and<br />

volunteers while abroad are deemed to have occurred while in the performance <strong>of</strong><br />

duty, and any disease contracted abroad is deemed to have been proximately caused<br />

by the employment. Except for the exclusions <strong>of</strong> willful misconduct, intent to bring<br />

about injury or death <strong>of</strong> self or another, or intoxication, which appear in section 8102<br />

<strong>of</strong> the <strong>FECA</strong> and section 5(d)(2) <strong>of</strong> the Peace Corps Act, volunteers have the<br />

protection <strong>of</strong> the <strong>FECA</strong> for all injuries sustained and diseases contracted during such<br />

service.<br />

(b) For episodic conditions, the medical evidence must show that the episode<br />

resulted from a condition contracted abroad. Only those episodes <strong>of</strong> a recurring<br />

disease that are shown to be associated with Peace Corps service by time and<br />

location or consequence are compensable. In the case <strong>of</strong> a disease, a medical report<br />
