claimant, the CE should send a copy to the employing agency with a request for completion<br />

<strong>of</strong> the reverse side <strong>of</strong> the form.<br />

If forms received from the employing agency lack essential information, which does not appear<br />

elsewhere in the file, a copy <strong>of</strong> the form must be returned for completion. The original form should<br />

always remain in the claim file.<br />

2-0800-5 Processing Claims<br />

5. Processing Claims. It is the policy <strong>of</strong> OWCP to minimize financial hardship to claimants by<br />

processing claims in the following order: death claims; cases where pay has been terminated, or will be<br />

terminated shortly; cases in which continuation <strong>of</strong> pay (COP) has been controverted; and uncontroverted<br />

COP cases. After ensuring that the forms are complete, the CE must evaluate them and any other<br />

material submitted to establish whether the case meets the five basic requirements <strong>of</strong> the claim. The CE<br />

will then take one <strong>of</strong> the following actions:<br />

a. Approve the Case. When the evidence is sufficient to determine that the five basic<br />

requirements have been met, the CE should:<br />

(1) Enter the accepted condition, case and adjudication status codes into the CMF.<br />

(2) In traumatic injury cases, determine if COP is payable (see <strong>FECA</strong> PM 2-807). In<br />

occupational disease cases and in those traumatic injury cases where the claimant is not<br />

entitled to COP but has lost wages, determine if compensation is payable (see <strong>FECA</strong> PM<br />

2-900) in accordance with timely payment procedures.<br />

(3) If the claimant has not returned to work, or if a schedule award is likely due to a<br />

significant injury to a schedule member, a letter <strong>of</strong> acceptance with findings <strong>of</strong> fact on the<br />

basic requirements will be released. The letter must include the date <strong>of</strong> injury, name <strong>of</strong><br />

the employer, accepted work-related condition(s), information regarding entitlement to<br />

COP, and instructions for filing a wage-loss claim. If the employing agency controverted<br />

the claim, the controversion must be addressed. A copy <strong>of</strong> the letter must be sent to the<br />

employing agency. Form letter CA-1008 may be used as the decision letter. CA-1009<br />

must be released as an attachment to the decision letter.<br />

b. Develop the Case. Development is usually undertaken by mail, although communication by<br />

telefax may be employed when an expeditious reply is required. The telephone should be used<br />

where the request involves answers to specific and simple questions, such as pay rate, date when<br />

pay stopped, or date when employee returned to work. Evidence obtained by telephone must be<br />

carefully documented in writing (on CA-110) and written confirmation should be requested from<br />

the source. In developing a claim, the CE should:<br />
