(4) If conflicting information appears concerning the salary or pay rate (e.g., Form CA-1<br />

and Form CA-7 show different pay rates), compensation should be paid using the lower <strong>of</strong><br />

the two pay rates until the matter is resolved.<br />

(5) If the case involves intermittent employment and additional information to establish<br />

the proper pay rate is needed, compensation should be paid using the "150 times" formula<br />

until the needed information is received. Since the "150 times" formula is the method <strong>of</strong><br />

last resort, the CE must attempt to establish a pay rate in accordance with 5 U.S.C. 8114<br />

which reasonably represents the earning capacity <strong>of</strong> the injured employee.<br />

(6) If the information is insufficient to establish even a daily pay rate, the CE should call<br />

the agency to obtain at least a minimum figure which can be used as the basis for the "150<br />

times" formula. The CE should then develop evidence to establish the correct pay rate.<br />
