2-0700-17 Periodic Roll Review<br />

17. Periodic Roll Review. The CE should review the case at least once a year to verify continuing<br />

entitlement to benefits, ensure that benefits are being paid at the proper level, resolve third party issues,<br />

and discontinue benefits when warranted. See paragraph 18 below concerning suspension <strong>of</strong> benefits for<br />

non-receipt <strong>of</strong> reports <strong>of</strong> dependents.<br />

a. Rescission. Once OWCP has accepted a fatal case and paid benefits, the CE should not<br />

reexamine the basis for acceptance or attempt to rescind it unless the file contains blatant error or<br />

clear indication <strong>of</strong> fraud. A recommendation to vacate the original decision must be routed through<br />

the District Director to the Director for Federal Employees' Compensation for review and final<br />

decision.<br />

b. Form CA-12, Claim for Continuation <strong>of</strong> Compensation. This form is sent annually to all<br />

recipients <strong>of</strong> death benefits. If the form has not been returned within 60 days <strong>of</strong> release, the CE<br />

should send a follow-up request for completion. Upon receipt <strong>of</strong> the form, the CE should check for<br />

changes in address, marital status, and financial dependency status. Particularly with elderly<br />

recipients <strong>of</strong> the form, the CE should be alert to changes in the beneficiary's signature; such<br />

changes may indicate that someone other than the intended recipient <strong>of</strong> benefits is completing the<br />

affidavit. The CE should also ensure that any address changes are also noted properly in the<br />

Automated Compensation Payment System (ACPS) and take any other actions required as noted<br />

below.<br />

c. Widows and Widowers. If the spouse has remarried, the CE will need to determine her or<br />

his age at the time <strong>of</strong> remarriage. A widow or widower over age 60 (prior to May 29, 1990) or<br />

over age 55 (May 29, 1990 or later) is entitled to continue receiving monthly benefits. If the<br />

surviving spouse is younger, the CE must initiate action to terminate benefits and pay the<br />

24-month lump sum.<br />

d. Children, Grandchildren, and Siblings. Form CA-1615 should be released to the guardian<br />

three months before the child reaches the age <strong>of</strong> 18 to determine continuing entitlement to<br />

compensation on the basis that the child is a student or is incapable <strong>of</strong> self-support.<br />

(1) Student Status.<br />

(a) ACPS automatically deletes the records <strong>of</strong> beneficiaries when they reach age<br />

18 and adjusts the percentages payable to other survivors. The CE should check the<br />

CP-285, however, to ensure that benefits are not interrupted if the child's<br />

entitlement continues after age 18.<br />
