(1)While at a Job Corps Center, an enrollee is under the continuous supervision and control<br />

<strong>of</strong> Job Corps <strong>of</strong>ficials. The Job Corps provides subsistence, quarters, clothing, medical care,<br />

training, work and recreation. For this reason an enrollee has the protection <strong>of</strong> the <strong>FECA</strong> for<br />

most incidents which occur while at the Center. Job Corps enrollees must, however, meet<br />

the same tests <strong>of</strong> compensability that apply to all other Federal employees.<br />

(2)While away from the Center, an enrollee has the protection <strong>of</strong> the <strong>FECA</strong> if participating in<br />

an activity authorized by or under the direction and supervision <strong>of</strong> a Center <strong>of</strong>ficial. This<br />

would include a group activity under the immediate direction <strong>of</strong> a supervisor as well as an<br />

authorized activity while the enrollee is on pass from the Center.<br />

The record in such a case should include (1) a statement from a Center <strong>of</strong>ficial showing<br />

whether at the time <strong>of</strong> the injury the enrollee was engaged in an authorized activity, and<br />

(2) a copy <strong>of</strong> the pass. Where a written pass was not issued, the Center <strong>of</strong>ficial should be<br />

asked for a statement showing the inclusive dates and hours covered by the pass and the<br />

instructions or limitations relating to the activity permitted the enrollee.<br />

(3)While on authorized pass or during travel between home and the Center, an enrollee has<br />

the protection <strong>of</strong> the <strong>FECA</strong>. In these cases, the record should include a statement from a<br />

Center <strong>of</strong>ficial showing whether the travel or activity while on pass was authorized by or<br />

under the direction and supervision <strong>of</strong> the Job Corps.<br />

(4)While absent from an assigned post <strong>of</strong> duty or participating in an unauthorized activity,<br />

an enrollee does not have the coverage <strong>of</strong> the Act.<br />

(5)While at home, an enrollee (whether on "pass" or on "leave") does not have the<br />

protection <strong>of</strong> the <strong>FECA</strong>. However, an enrollee who is visiting the residence <strong>of</strong> another<br />

enrollee, with the permission <strong>of</strong> the Job Corps, would be considered to be engaged in an<br />

authorized activity, and would therefore be covered during the entire absence from the<br />

Center.<br />

(6)Some enrollees live <strong>of</strong>f the premises <strong>of</strong> their Center and commute between their home<br />

and the Center for training. The usual rules governing coverage during travel to and from<br />

work apply in "<strong>of</strong>f-premises" injury situations.<br />

(7) Injuries resulting from "horseplay" and "fighting" are frequent among the enrollees. It<br />

is the OWCP's position that most <strong>of</strong> these injuries come within the scope <strong>of</strong> the <strong>FECA</strong>. The<br />

confining nature <strong>of</strong> the employment and the long absences from home are factors which<br />

contribute to this problem. The result is that "horseplay" and "fighting" are an expected<br />

element <strong>of</strong> the employment environment. Where so indicated, the district <strong>of</strong>fices should<br />

fully develop the facts in any case where it appears the exclusions <strong>of</strong> 5 U.S.C. 8102 might<br />

require consideration.<br />

e. Medical Care after Termination.<br />

(1) Prior to the termination <strong>of</strong> enrollment, an enrollee may not be provided medical care at<br />

OWCP expense and the Job Corps may not properly issue an authorization for examination<br />
