2-0813 Exhibit 1: Sample <strong>Letter</strong> to Claimant Who Is Authorized Medical Care for Substance<br />

Abuse<br />

Dear CLAIMANT NAME:<br />

I am writing in reference to your compensation claim with this <strong>of</strong>fice, and in particular to the substance<br />

abuse which has been addressed in reports (copies attached) from your attending physician,<br />

Dr._________. This condition has been documented as hindering your [participation in rehabilitation<br />

services, ability to accept employment <strong>of</strong>fered by your employing agency, etc.]<br />

This Office has approved an [inpatient, outpatient] treatment program for substance abuse at [name <strong>of</strong><br />

facility]. At the conclusion <strong>of</strong> the course <strong>of</strong> treatment, which is expected to end on [date], it is anticipated<br />

that you will be able to [resume your participation in rehabilitation services, accept the <strong>of</strong>fered position,<br />

etc.]<br />

If the expected improvement does not occur, or if substance abuse continues after the completion <strong>of</strong> the<br />

program, your compensation benefits will be partially suspended until you re-enter a program and<br />

discontinue abuse <strong>of</strong> the substance in question. Your benefits will be suspended at the rate <strong>of</strong> pay which<br />

reflects your wage-earning capacity, as represented by the salary level <strong>of</strong> the job which is the goal <strong>of</strong><br />

training. This action will be taken under authority <strong>of</strong> section 5 U.S.C. 8113 <strong>of</strong> the Federal Employees'<br />

Compensation Act. [For claimants whose substance abuse has been accepted as work-related: Additional<br />

treatment for substance abuse will be authorized only under exceptional circumstances.] [For claimants<br />

whose substance abuse is not accepted as work-related: The cost <strong>of</strong> any further treatment will be your<br />

responsibility.]<br />
