COP is paid for the entire period <strong>of</strong> any continuous disability which extends beyond the 45-day limit as<br />

long as the 45 days have not been used. Any valid period <strong>of</strong> entitlement to COP for the injury must begin,<br />

however, within 45 days <strong>of</strong> the injury or <strong>of</strong> the first return to work after the injury.<br />

2-0807-14 Interruption, Suspension and Termination <strong>of</strong> COP<br />

14. Interruption, Suspension and Termination <strong>of</strong> COP.<br />

a. Effect <strong>of</strong> Disciplinary Action. 20 C.F.R. 10.222(b). COP may be terminated when a<br />

preliminary notice <strong>of</strong> disciplinary action is issued before the injury and becomes final during the<br />

COP period. The CE must ensure that the case file contains documentation that the preliminary<br />

notice <strong>of</strong> termination was in fact issued prior to the date <strong>of</strong> injury. Where these conditions are not<br />

met, the CE must advise the agency to continue pay.<br />

b. Effect <strong>of</strong> Refusal/Obstruction <strong>of</strong> Medical Examination. If an employee refuses to submit to<br />

or obstructs an examination required by the Office under the provisions <strong>of</strong> 5 U.S.C. 8123(a), COP<br />

paid or payable during the period <strong>of</strong> the refusal is forfeited and is subject to recovery by the<br />

employing agency. Action to deny payment <strong>of</strong> COP and any subsequent compensation may be<br />

taken only if the claimant was advised <strong>of</strong> the provisions <strong>of</strong> 20 CFR 10.323 and 5 U.S.C. 8123(d)<br />

when the appointment was arranged. If a suspension occurs during the COP period, the CE must<br />

notify the agency immediately <strong>of</strong> the suspension and its effective date 20 C.F.R. 10.223.<br />

c. Criteria for Termination. COP should not be terminated until one <strong>of</strong> the following<br />

circumstances occurs:<br />

(1) OWCP advises the agency that pay should be terminated. Where termination <strong>of</strong> COP<br />

in a specific case depends upon the termination date <strong>of</strong> temporary or seasonal employment,<br />

the CE should determine the ending date <strong>of</strong> employment in accordance with the following:<br />

(a) Seasonal Firefighters--the end <strong>of</strong> the fire season in the geographical area as<br />

determined by the U.S. Forest Service.<br />

(b) Emergency Firefighters--the date on which other Emergency Firefighters in<br />

the employee's work group would be terminated due to cessation <strong>of</strong> activities.<br />
