4. Factors in Computing Compensation. This paragraph defines the factors which enter into the<br />

computation <strong>of</strong> a payment for disability or death, and are established by statute. They are: the pay rate<br />

by day, week, month or year, including any increments such as night differential or Sunday pay; the<br />

compensation rate; the work or calendar day determination; the period <strong>of</strong> entitlement; and various<br />

adjustments to compensation reflecting health benefits, life insurance deductions, cost-<strong>of</strong>-living increases,<br />

wage-earning capacity, actual earnings, and minimum and maximum payments.<br />

a. All Cases (Disability and Death. The CE must consider the following factors:<br />

(1) The pay rate on which to base compensation. See <strong>FECA</strong> PM 2-0900 and <strong>FECA</strong><br />

Program Memorandums.<br />

(2) The period <strong>of</strong> entitlement. See paragraph 6 below.<br />

(3) Whether the claimant is enrolled in a health benefits plan and, if so, under what plan<br />

and for what period premiums should be deducted. Form CA-1003 may be used to obtain<br />

this information. See <strong>FECA</strong> PM 5-400.<br />

(4) Who shall receive the compensation payable for a claimant who is incompetent. See<br />

paragraph 18 below.<br />

b. Disability Cases. The CE must also decide:<br />

(1) The compensation rate (percentage <strong>of</strong> pay). See paragraph 5 below.<br />

(2) Whether the three-day waiting period is applicable and, if so, the dates covered.<br />

See paragraph 6 below.<br />

(3) Whether premiums for optional life insurance should be deducted, and if so, the date<br />

on which OWCP should begin deductions (see <strong>FECA</strong> PM 5-0400). Form CA-1003 may be<br />

used to obtain this information.<br />

(4) Whether an attendant's allowance is payable, and if so, in what amount (see <strong>FECA</strong><br />

PM 2-0812.8).<br />

c. Death Cases. The CE must also decide:<br />

(1) The persons entitled to receive compensation because <strong>of</strong> death and the rates at<br />

which compensation is payable to each, as well as payments for beneficiaries who are<br />

minors, students, or incompetent. See paragraph 5 below.<br />
