d. Decision. An untimely application for reconsideration should be denied according to Title 20<br />

CFR Part 10.608(b), as follows:<br />

(1) If clear evidence <strong>of</strong> error has not been presented, the SrCE should deny the<br />

application by letter decision, which includes a brief evaluation <strong>of</strong> the evidence submitted<br />

and a finding made that clear evidence <strong>of</strong> error has not been shown. The claimant's only<br />

appeal from this decision is to request a review <strong>of</strong> the decision by the ECAB.<br />

(2) If clear evidence <strong>of</strong> error has been presented with an untimely application, the SrCE<br />

should first deny the application by letter decision. Then a merit review on the Director’s<br />

own motion should be undertaken. The <strong>FECA</strong> specifies that an award for or against<br />

payment <strong>of</strong> compensation may be reviewed at any time on the Director's own motion. Such<br />

review may be made without regard to whether there is new evidence or information.<br />

If the Director determines that a review <strong>of</strong> the award is warranted (including, but not<br />

limited to circumstances indicating a mistake <strong>of</strong> fact or law or changed conditions), the<br />

Director (at any time and on the basis <strong>of</strong> existing evidence) may modify, rescind, decrease<br />

or increase compensation previously awarded, or award compensation previously denied. A<br />

review on the Director's own motion is not subject to a request or petition and none shall be<br />

entertained. See 20 C.F.R. § 10.610.<br />

(a) The decision whether or not to review an award under this section is solely within<br />

the discretion <strong>of</strong> the Director. The Director's exercise <strong>of</strong> this discretion is not subject to<br />

review by the ECAB, nor can it be the subject <strong>of</strong> a reconsideration or hearing request.<br />

(b) Where the Director reviews an award on his or her own motion, any resulting<br />

decision is subject as appropriate to reconsideration, a hearing and/or appeal to the<br />

ECAB. Jurisdiction on review or on appeal to ECAB is limited to a review <strong>of</strong> the merits <strong>of</strong><br />

the resulting decision. The Director's determination to review or not to review an award<br />

is not reviewable, i.e., is not subject to appeal.<br />

4. Evidence or Argument Required. In accordance with the regulations set forth in 20<br />

CFR §10.606, all requests for reconsideration should be accompanied by one <strong>of</strong> the<br />

following:<br />

a. Argument that the Office Erroneously Applied or Interpreted a Point <strong>of</strong> Law. [See 20 CFR<br />

§606 (b) (2) (i)]. For example, the CE failing to use the Shadrick formula when calculating an<br />

LWEC, or failing to include all appropriate elements <strong>of</strong> pay when determining a pay rate for<br />

compensation purposes. Or,<br />

b. Relevant Legal Argument not Previously Considered by OWCP. [See 20 CFR §606 (b) (2)<br />

(ii)]. For example, in a case that was denied on the basis <strong>of</strong> a medical opinion <strong>of</strong> a referee<br />

specialist, the introduction <strong>of</strong> evidence to support a prior connection between the referee physician<br />

and the employing agency would be sufficient to require the Office to reopen the case for a review<br />
