. Decision. If the evidence submitted is not sufficient to require a merit review, the SrCE<br />

should:<br />

(1) Prepare a Decision which discusses the evidence submitted and explicitly states the<br />

basis for the finding <strong>of</strong> insufficiency. The SrCE must not include any statement<br />

suggesting that review on the merits <strong>of</strong> the claim was undertaken. Evaluative<br />

statements such as the evidence lacks substantial probative value are not<br />

appropriate where the decision denies the application for review.<br />

(2) Include a cover letter explaining that the application for reconsideration is denied on<br />

the basis that the evidence submitted in support <strong>of</strong> the application is not sufficient to<br />

warrant review.<br />

(3) Release the decision over his or her own signature.<br />

The claimant's only appeal from this decision is to request review by the ECAB. (However, see paragraph<br />

3b above concerning contested decisions issued before June 1, 1987.)<br />

2-1602-8 Merit Reviews<br />

8. Merit Reviews. Where the application is accompanied by new and relevant evidence or by an<br />

arguable case for error, the SrCE will conduct a merit review <strong>of</strong> the case to determine whether the prior<br />

decision should be modified.<br />

a. Comment by Employing Agency. As soon as the SrCE decides that an application is<br />

sufficient to warrant reconsideration <strong>of</strong> the case, he or she should send a copy <strong>of</strong> the application,<br />

together with copies <strong>of</strong> pertinent supporting documentation, to the employing agency for review<br />

and comment. See 20 CFR § 10.609.<br />

(1) Such documentation includes any factual evidence submitted with the<br />

reconsideration request. However, medical evidence submitted with the request shall not be<br />

furnished to the employing agency, since it does not constitute documentation that is<br />

"pertinent" for review and comment by the employing agency.<br />
