In some instances, however, it may be appropriate to send the compensation check in care <strong>of</strong><br />

another party, i.e. court appointed guardian, executor, or administrator <strong>of</strong> the estate. In<br />

questionable instances the CE should refer the case to the Assistant District Director with an<br />

appropriate recommendation.<br />

2-1200-9 Fee Requests in Disallowed Claims<br />

9. Fee Requests in Disallowed Claims. Where a compensation claim is disallowed, a formal<br />

decision will be made on the representative's fee application. It will be sent to the representative with a<br />

copy <strong>of</strong> the disallowance. In such cases, a reasonable representative's fee may be approved after full<br />

consideration is given to all factors discussed in paragraph 6 above. The fact that the compensation claim<br />

is disallowed is insufficient to deny a representative a reasonable fee for services necessary to pursue the<br />

claim. See Robert D. Shaw, 30 ECAB 257 (1978).<br />
