(3) The Designated Claims Examiners (DCE) are responsible for ensuring that third party<br />

cases are processed in a timely manner and in accordance with the procedures outlined in<br />

this subchapter. This includes the responsibility for timely communications with the<br />

appropriate party (i.e., the claimant, the employing agency, SOL, etc.).<br />

(4) Cases in the Branch <strong>of</strong> Hearings and Review. Where a case has been transferred to<br />

the Branch and Review. If the case is one which has not previously been identified as one<br />

involving potential third-party liability, the initial notification letter (CA-1045) will be<br />

prepared and released by the owning DO, but the responsibility for handling the rest <strong>of</strong> the<br />

third-party issues will remain with the normally responsible entity (OWCP district <strong>of</strong>fice,<br />

SOL <strong>of</strong>fice, or USPS, as appropriate).<br />

b. SOL. The Division <strong>of</strong> FEEWC, Office <strong>of</strong> the Solicitor, Department <strong>of</strong> Labor, Washington,<br />

D.C. is responsible for administering <strong>FECA</strong> subrogation aspects <strong>of</strong> any cases referred for that<br />

purpose, and for assisting the DO in regard to <strong>FECA</strong> subrogation issues in cases not referred to SOL<br />

pursuant to <strong>FECA</strong> PM 2-1100.7.d.<br />

Pursuant to 20 C.F.R. § 10.705, SOL has been delegated authority to administer the third-party<br />

subrogation aspects <strong>of</strong> certain <strong>FECA</strong> claims for OWCP. FEEWC has responsibility over all delegated<br />

third party claims in the district <strong>of</strong>fices and any other cases FEEWC has agreed to handle on the<br />

specific request <strong>of</strong> a DO or the USPS. In addition, FEEWC coordinates national policy concerning<br />

pursuit <strong>of</strong> refunds due to the United States, and, through the Chief, Subrogation Unit and the<br />

Deputy Associate Solicitor, serves as an adviser to the district <strong>of</strong>fices.<br />

c. Inquiries pertaining to a specific third party case will be referred to the DCE, FEEWC, or the<br />

USPS. The DCEs are responsible for responding to general questions concerning third party<br />

matters.<br />

4. <strong>Letter</strong>s, Forms and Status Codes.<br />

a. The following letters and forms are used in processing third party cases (Please note that,<br />

where the form has been approved by the Office <strong>of</strong> Management and Budget (OMB); OWCP, SOL,<br />

and USPS must use the OMB-approved form):<br />

(1) Ltr. CA-1045, Notice <strong>of</strong> Third Party Rights and Obligations.<br />

(2) CA-1121, Request for Information Concerning Third Party Aspect.<br />

(3) Ltr. CA-1108, Notice <strong>of</strong> Third Party Obligations (sent by OWCP to attorney).<br />

(4) Ltr. SOL-1108, Notice <strong>of</strong> Third Party Obligations (sent by SOL to attorney)<br />

(5) Form EN-1108, Long Form Statement <strong>of</strong> Recovery.<br />
