(a) The case is being referred because the evidence submitted by the claimant<br />

resulted in a conflict <strong>of</strong> medical opinion requiring resolution by an impartial medical<br />

specialist;<br />

(b) The results <strong>of</strong> this referral may lead to immediate termination (or reduction)<br />

<strong>of</strong> compensation, with no second notice <strong>of</strong> proposed action; and<br />

(c) The claimant should submit any further relevant evidence or argument within<br />

30 days.<br />

(2) Review by District Medical Adviser (DMA). The CE may need to consult the DMA for<br />

technical advice in evaluating medical evidence. In such instances, where the DMA's<br />

comments do not constitute "evidence upon which the decision was based", the CE need not<br />

furnish them to the claimant as part <strong>of</strong> the OWCP's decision.<br />

(3) Second Notice Not Required. The CE need not issue a second notice <strong>of</strong> proposed<br />

action based on either the contents <strong>of</strong> the specialist's report or any delay in receiving it.<br />

e. Outcomes. After the CE has considered any response <strong>of</strong>fered to a pre-reduction or<br />

pre-termination notice and taken appropriate action, he or she should issue one <strong>of</strong> the following:<br />

(1) A <strong>Letter</strong> Advising That Benefits Will Continue.<br />

(2) A Notice <strong>of</strong> Decision. A copy <strong>of</strong> the notice <strong>of</strong> proposed termination or reduction<br />

should be included.<br />
