2-1400 Exhibit 4: Sample <strong>Letter</strong> Conveying Proposed Reduction<br />

Dear CLAIMANT NAME:<br />

Under the provisions <strong>of</strong> the Federal Employees' Compensation Act<br />

(5 U.S.C. 8101 et seq.) and the program's regulations (20 C.F.R. 10.1<br />

et seq.), we propose to reduce your compensation for wage loss on account <strong>of</strong> the injury identified above<br />

to reflect your wage-earning capacity. The enclosed Notice <strong>of</strong> Proposed Decision dated March 19, 1996<br />

describes the basis for this action.<br />

Also enclosed are copies <strong>of</strong> the final rehabilitation report dated February 6, 1996, the reports <strong>of</strong> Dr. Esther<br />

Parks dated September 17, 1995 and March 6, 1996, and Form CA-816, which shows how we have<br />

computed your wage-earning capacity.<br />

If you disagree with the proposed action, you may submit additional evidence or argument relevant to<br />

your capacity to earn wages in the position described in the Notice <strong>of</strong> Proposed Decision.<br />

You should send any such evidence or argument to this <strong>of</strong>fice within 30 days <strong>of</strong> the date <strong>of</strong> this letter. We<br />

will not reduce your compensation during this 30-day period. If no response is received within 30 days,<br />

however, we will reduce your compensation at that time.<br />
