4. Determining Date Claim is Filed. This paragraph addresses how the date <strong>of</strong> filing is determined.<br />

This date is the date <strong>of</strong> receipt <strong>of</strong> a claim by the OWCP or by the employing agency, rather than the date<br />

the claim was completed.<br />

a. Forms CA-1, CA-2, CA-5, CA-5b and CA-7 constitute claims for the purpose <strong>of</strong> considering<br />

the time requirements. The CE must determine whether the claim was received by OWCP or the<br />

employing agency within the time specified in paragraph 3. In most cases, this may be established<br />

by:<br />

(1) The entries on Form CA-1 or CA-2;<br />

(2) The date <strong>of</strong> receipt noted by the employing agency or OWCP;<br />

(3) The date the employing agency transmitted it to OWCP;<br />

(4) The date the <strong>of</strong>ficial superior completed the claim form; or<br />

(5) A statement from the <strong>of</strong>ficial superior confirming the date the claim was received by<br />

the employing agency.<br />

b. If a prescribed claim form has not been timely filed, the CE should consider any written<br />

documents from the person claiming benefits, or someone acting on this person's behalf, from<br />

which the substance <strong>of</strong> a claim can be reasonably deduced.<br />

(1) If the injured employee is still working, the <strong>of</strong>ficial superior should be asked to<br />

examine the <strong>of</strong>ficial personnel file or other records, and provide OWCP with any<br />

communication from or on behalf <strong>of</strong> the claimant which may contain words <strong>of</strong> claim.<br />

(2) Where the injured employee is not still employed by the Federal Government, and if<br />

there is any indication <strong>of</strong> earlier communication about a claim, the CE should request the<br />

<strong>of</strong>ficial personnel file from the Federal Records Center. If any document in this file contains<br />

words <strong>of</strong> claim the CE should place a copy in the OWCP file along with memorandum<br />

identifying the document and its source.<br />

(3) Decisions concerning the use <strong>of</strong> a document other than a prescribed form as a claim,<br />

should be made at an adjudicative level above that <strong>of</strong> the CE.<br />
