02-1100-1 Purpose and Scope<br />

1. Purpose and Scope. This subchapter outlines the procedures for administering the government’s<br />

rights under §§ 8131 and 8132 <strong>of</strong> the <strong>FECA</strong> to require <strong>FECA</strong> claimants to seek damages from third parties<br />

potentially liable for damages as a result <strong>of</strong> the <strong>FECA</strong>-covered injuries, and to refund a portion <strong>of</strong> any<br />

money or other property recovered. This is referred to as “<strong>FECA</strong> subrogation.” This subchapter addresses<br />

the responsibilities <strong>of</strong> the Office <strong>of</strong> the Solicitor (SOL) and District Office (DO) personnel in identifying and<br />

administering cases involving potential third party actions; the interrelationship between DO personnel<br />

and SOL personnel in the Division <strong>of</strong> Federal Employees’ and Energy Workers’ Compensation (FEEWC)<br />

(formerly the Division <strong>of</strong> Employee Benefits) at the <strong>National</strong> Office concerning these actions; and the<br />

handling <strong>of</strong> cases involving litigation in federal court. The necessity for careful evaluation <strong>of</strong> the<br />

appropriate course <strong>of</strong> action regarding a third party case occurs regularly in the claims adjudication<br />

process. Except to the extent specifically provided herein, these procedures apply to actions taken by the<br />

United States Postal Service (USPS) in pursuing third party claims. (See <strong>FECA</strong> PM 2-700.13 and 2-800.3.)<br />
