(2) Sanctions for Failing or Refusing to File an SOR. The duty to file a SOR is part <strong>of</strong> a<br />

beneficiary’s duty to prosecute. Whenever OWCP/FEEWC determines that the beneficiary<br />

has failed to timely file a SOR, OWCP/FEEWC may at its discretion utilize the procedures<br />

and sanctions listed above in 2-1000-8(d)(2).<br />

c. Allocation <strong>of</strong> Joint Recoveries. When a settlement or judgment is paid to, or for, one<br />

individual, the entire amount is reported as the gross recovery on Line 1 <strong>of</strong> the SOR. If a<br />

settlement or judgment is paid to, or for, more than one individual, or in more than one capacity,<br />

such as a joint payment to a husband and wife for personal injury and loss <strong>of</strong> consortium or a<br />

payment to a spouse representing both loss <strong>of</strong> consortium and wrongful death; the entire amount<br />

is still reported as the gross recovery on Line 1 <strong>of</strong> the SOR, from which certain deductions may be<br />

made to arrive at the amount to be allocated to the injured employee. If a judge or jury specifies<br />

the percentage <strong>of</strong> a contested verdict attributable to each <strong>of</strong> several plaintiffs, that division will be<br />

accepted.<br />
