2-0806-1 Purpose and Scope<br />

1. Purpose and Scope. This chapter contains procedures for developing, adjudicating and managing<br />

claims for occupational disease (OD). It supplements information about developing claims (<strong>FECA</strong> PM<br />

2-0800); the five basic requirements (<strong>FECA</strong> PM 2-0801 through 2-0805); weighing medical evidence<br />

(<strong>FECA</strong> PM 2-0810); and case management (<strong>FECA</strong> PM 2-0600).<br />

2-0806-2 Responsibilities<br />

2. Responsibilities. The purpose <strong>of</strong> this paragraph is to describe the basic responsibilities <strong>of</strong> the<br />

claimant, the employing agency, and the OWCP in handling OD claims.<br />

a. Claimant. The claimant has the burden <strong>of</strong> establishing that the claimed condition is causally<br />

related to factors <strong>of</strong> Federal employment (see 20 CFR 10.100 and <strong>FECA</strong> PM 2-0805). However,<br />

the OWCP should provide the claimant with guidance and assistance.<br />

b. Employing Agency. When issuing a Form CA-2, the supervisor or injury compensation<br />

specialist should provide the claimant with a checklist showing the type <strong>of</strong> evidence which is to be<br />

submitted. The checklists are as follows:<br />

(1) General checklist (CA-35A);<br />

(2) Hearing loss (CA-35B);<br />

(3) Asbestos-related illness (CA-35C);<br />

(4) Coronary/vascular conditions (CA-35D);<br />

(5) Skin diseases (CA-35E);<br />

(6) Pulmonary illness other than asbestosis (CA-35F);<br />

(7) Psychiatric illness (CA-35G); and<br />

(8) Carpal tunnel syndrome (CA-35H).<br />

Sample development letters corresponding to the illnesses addressed by the checklists appear as<br />

Exhibits 2-19. Sample questions for other conditions are found in Exhibit 20.<br />

c. OWCP. To adjudicate OD claims promptly and manage them effectively, the CE must<br />

choose the most efficient, direct, and pro-active approach given the individual circumstances <strong>of</strong> a<br />

claim and the nature <strong>of</strong> injury.<br />
