(c) Census Enumerators--the date on which the employee's assignment was<br />

completed. This is usually the date <strong>of</strong> completion <strong>of</strong> the short-term enumerating<br />

project or survey for which the employee was hired.<br />

(d) Temporary Postal Workers--the date the assignment would have ended were<br />

it not for the injury.<br />

(e) Other seasonal or temporary workers--the date the assignment would have<br />

ended were it not for the injury.<br />

(2) The 45-day period expires, except that an employee who is scheduled to be<br />

separated and suffers a traumatic injury on or before the separation date shall be separated<br />

regardless <strong>of</strong> the injury. The employee is not entitled to COP after the date <strong>of</strong> termination.<br />

(a) In the case <strong>of</strong> permanent employees, the date <strong>of</strong> termination must be<br />

established in writing prior to the injury.<br />

(b) In the case <strong>of</strong> temporary employees, the notice <strong>of</strong> appointment <strong>of</strong>ten<br />

indicates the date on which the appointment expires. If a temporary worker's term<br />

<strong>of</strong> employment is changed, written notice <strong>of</strong> the change is necessary to support<br />

termination <strong>of</strong> COP at an earlier date.<br />

(3) The agency is advised by the attending physician that the employee is no longer<br />

disabled.<br />

(a) The phrase "no longer disabled" applies to regular work. Obviously, COP<br />

should be discontinued when an employee returns to full regular duty.<br />

(b) The employing agency should also terminate COP when a partially disabled<br />

employee returns to full-time suitable light duty without <strong>of</strong>ficial reassignment and<br />

without pay loss.<br />
