General (OIG), the Inspection Service <strong>of</strong> the United States Postal Service, employing agencies, or<br />

other persons, including United States Attorneys' <strong>of</strong>fices, if a person receiving or claiming benefits<br />

under the <strong>FECA</strong> is convicted <strong>of</strong> filing a false claim or statement (i.e., submitting a false Form<br />

CA-1032) or otherwise defrauding the <strong>FECA</strong> program, or is convicted <strong>of</strong> another felony resulting in<br />

imprisonment.<br />

c. Nature <strong>of</strong> Conviction. On receiving such information, the CE should determine the exact<br />

nature <strong>of</strong> the conviction and the provision <strong>of</strong> section 5 U.S.C. 8148 which applies.<br />

(1) Paragraph (a) (or Public Law 103-112, for convictions between October 21, 1993 and<br />

September 30, 1994), addresses only convictions for fraud in connection with claims under<br />

the <strong>FECA</strong>. It requires termination <strong>of</strong> all benefits, including those for dependents. The<br />

definition <strong>of</strong> fraud is found in section 18 U.S.C. 1920, as shown in Exhibit 9.<br />

(2) Paragraph (b) addresses convictions and imprisonments for felonies unrelated to<br />

claims under the <strong>FECA</strong>, and it allows for payments to dependents.<br />

d. Documentation. Before any action is taken to terminate or suspend compensation, the file<br />

must contain: a copy <strong>of</strong> the indictment or information; a copy <strong>of</strong> the plea agreement, if any; a<br />

copy <strong>of</strong> the document containing a guilty verdict; and/or a copy <strong>of</strong> the court's docket sheet. Such<br />

documents must not only contain evidence establishing that the person was convicted, but also<br />

that the conviction is related to the claim for, or receipt <strong>of</strong>, any benefits under the <strong>FECA</strong>.<br />
