c. Injuries On and After September 7, 1974. If the file reflects that the claimant is receiving<br />

retirement or retainer pay, compensation will be paid for appropriate periods. It will not be necessary to<br />

notify the military finance <strong>of</strong>fices that compensation payments are being made. There is no need for<br />

OWCP to be concerned with reductions applicable to 5 U.S.C. 5532 since these reductions apply to the<br />

wages the recipient is receiving and will always have occurred before any injury compensable under the<br />

<strong>FECA</strong>.<br />

2-1000-11 Social Security Benefits<br />

11. Social Security Benefits. References: <strong>FECA</strong> ProM Nos. 10, 20 and 81.<br />

a. OASD Benefits. Old age, survivors, and disability under Title II <strong>of</strong> the Social Security Act, as<br />

amended, are insurance benefits paid from the Social Security insurance fund. These payments<br />

are financed by the contributions <strong>of</strong> employees and employers through the Social Security tax, and<br />

are not financed by the United States. Social Security benefits are payable only to persons insured<br />

under the system by their respective payments to the system's insurance fund.<br />

b. Dual Payment Not Prohibited. OWCP does not require an election between <strong>FECA</strong> benefits<br />

and Social Security benefits, except when they are attributable to the employee's Federal service<br />

(see paragraph 4e above). The Social Security Act was amended on July 30, 1965, providing for a<br />

reduction in Social Security benefits to certain individuals receiving workers' compensation.<br />

Inquiries concerning this situation should be referred to the Social Security Administration. That<br />

agency will inform the beneficiary concerning the possible reduction <strong>of</strong> Social Security benefits.<br />

2-1000-12 Tennessee Valley Authority<br />

12. Tennessee Valley Authority. References: <strong>FECA</strong> ProM No. 177.<br />

a. Pension Plan. The Tennessee Valley Authority Retirement System is a private pension plan.<br />

The limitations in 5 U.S.C. 8116 apply solely to situations where there is concurrent entitlement to<br />

compensation and to some other Federal benefit(s).<br />

b. Dual Payment Not Prohibited. An election between <strong>FECA</strong> benefits and benefits under the<br />

TVA Retirement System is not required by OWCP. Under certain circumstances, the TVA may find<br />

that all or part <strong>of</strong> its retirement benefits are not payable concurrently with <strong>FECA</strong> benefits.<br />

Requests for <strong>of</strong>fset <strong>of</strong> <strong>FECA</strong> compensation payments to repay overpayments made under the TVA<br />

Retirement System will be honored only upon written authority <strong>of</strong> the affected beneficiary.<br />
