This equation avoids any distortion <strong>of</strong> the employee's earning power.<br />

(2) Determine the weekly pay rate by multiplying the average daily wage earned within<br />

the year prior to the date <strong>of</strong> injury by 150:<br />

P = Total pay earned during one year prior to injury (excluding overtime)<br />

H = Total number hours worked<br />

P/H = Y (Average hourly pay rate)<br />

Y x 8 x 150/52 = Average weekly earnings.<br />

f. <strong>National</strong> Guard and Military Reserve. Where membership in the <strong>National</strong> Guard or the<br />

military reserve is a condition <strong>of</strong> employment, COP includes military drill and field training pay only<br />

in the limited circumstances where there is an actual loss <strong>of</strong> military pay. For example, an<br />

individual who at the end <strong>of</strong> the year has not completed the physical training requirements sustains<br />

an injury and loses military pay, such loss <strong>of</strong> military pay must be included in the pay rate for COP<br />

purposes. On the other hand, if the agency is able to provide alternative military training activities<br />

to injured federal employees, so that these injured employees do not actually "lose" military pay<br />

during the 45-day COP period, it is proper not to include such constructive military pay for COP<br />

purposes.<br />

g. Jurors. The pay rate <strong>of</strong> jurors is computed in accordance with paragraphs a-e above.<br />

h. Incorrect Pay Rates. Where the agency continues pay at a rate OWCP subsequently finds<br />

incorrect, the CE shall notify the agency <strong>of</strong> the correct pay rate and the agency will make the<br />

necessary adjustment.<br />
