(3) The case must be coded as withdrawn and the imaged copy retained by the Office. The<br />

CE should code the claim as follows:<br />

Adjudication Status: SU<br />

Case Status: CL<br />

Rep/Acc flag: N<br />

(4) In traumatic injury cases, determine if COP is payable (see <strong>FECA</strong> PM 2-807). Any COP<br />

paid will be charged to either sick or annual leave or become an overpayment with the<br />

employing agency. The claimant, not the employing agency, should make the choice <strong>of</strong><br />

electing either sick or annual leave.<br />

(5) Employing agencies are not permitted to compel any employee to withdraw a claim.<br />

However, if OWCP is notified <strong>of</strong> an allegation that an employing agency has compelled a<br />

claimant or survivor to withdraw a claim, the CE must immediately advise district <strong>of</strong>fice<br />

management in writing.<br />

(6) Upon notification <strong>of</strong> a credible allegation that the employing agency may have<br />

improperly compelled the claimant or survivor to withdraw a claim, the district <strong>of</strong>fice<br />

manager should immediately contact the employing agency by telephone or written<br />

correspondence to discuss the matter and to prevent future occurrences. The telephone<br />

conversation must be documented on Form CA-110 and imaged in the case file. (See <strong>FECA</strong><br />

Regulations, 20 C.F.R. 10.117(b)).<br />

(7) A claim may be reinstated if a district <strong>of</strong>fice manager has concerns that a claimant or<br />

survivor may have been compelled by the employing agency to withdraw his or her claim.<br />

2-0800-6 Evidence<br />

6. Evidence. Decisions on claims are based on the written record, which may include forms, reports,<br />

letters, and other evidence <strong>of</strong> various types such as photographs, drawings, and X-rays. Evidence may<br />

not be incorporated by reference, nor may evidence from another case file be used. Most <strong>of</strong> the evidence<br />

required in a compensation claim is obtained from the following sources:<br />

a. Claimant. In disability cases, the claimant is the injured employee, while in death cases the<br />

claimant is the dependent seeking benefits. The claimant must always submit enough evidence to<br />

establish a prima facie case and other evidence which the Office may require.<br />

b. Employing Agency. The employing agency is required to complete the reports and<br />

statements needed from it and then submit the evidence to OWCP. Unless the employee has long<br />

since left the agency's rolls, it should also assist the claimant in completing the notice <strong>of</strong> injury,<br />

claim form, and other evidence.<br />
