f. The injury was not reported on a form approved by OWCP within 30 days following the<br />

injury, 20 C.F.R. 10.220(c);<br />

g. Work stoppage first occurred 45 days or more following the injury, 20 C.F.R. 10.220(g);<br />

h. The employee initially reported the injury after employment was terminated, 20 C.F.R.<br />

10.220(d); or<br />

i. The employee is enrolled in the Civil Air Patrol, Peace Corps, Job Corps, Youth Conservation<br />

Corps, a Work Study Program, or a similar group, 20 C.F.R. 10.200(c).<br />

In all other cases, the employing agency may controvert an employee's right to COP, but the employee's<br />

regular pay shall not be interrupted during the 45-day period unless the controversion is sustained by<br />

OWCP and until the employing agency is so notified.<br />

2-0807-10 Adjudicating the Claim for COP<br />

10. Adjudicating the Claim for COP. The CE should give priority to "terminated pay" cases and<br />

determine whether the employing agency's action is correct, taking the following steps:<br />

a. If additional information is needed, the CE shall release an appropriate letter requesting<br />

additional information.<br />

b. If COP is denied, the CE will release a decision denying COP.<br />

c. If COP is approved, the CE will release an acceptance letter, which indicates the accepted<br />

condition and notifies the claimant <strong>of</strong> the procedures to follow if compensation is claimed. Once a<br />

claim is received, the CE will take prompt action on it; see paragraph 17 below. If the employing<br />

agency controverted the claim, it is entitled to know why the specific objections were not upheld.<br />

The CE must make a<br />

finding on the issues raised by the employer, and include an explanation <strong>of</strong> the decision on COP.<br />

d. If only a portion <strong>of</strong> the period <strong>of</strong> COP can be approved because the employee did not meet<br />

his or her responsibilities as described in paragraph 7 above, the decision should state the dates<br />

for which COP is approved, and explain why other dates claimed are denied.<br />

e. In a case where a juror who is also a Federal employee is eligible for COP, the CE should<br />

forward a copy <strong>of</strong> Form CA-1 to the employing agency advising it to continue the employee's pay<br />

beginning the day after the date <strong>of</strong> the employee's termination <strong>of</strong> service as a juror.<br />
