the request <strong>of</strong> the Office. The claimant shall pay fees requested by witnesses who have submitted<br />

evidence into the case record at the request <strong>of</strong> the claimant. If H&R determines that issuance <strong>of</strong> a<br />

subpoena is not reasonably necessary to present the case fully, a formal denial <strong>of</strong> the request for<br />

subpoena, with an explanation for such denial, will be included with the final decision (see<br />

paragraph 8e below).<br />

2-1601-7 Conduct <strong>of</strong> Hearings<br />

7. Conduct <strong>of</strong> Hearings. This paragraph describes the steps involved in the hearing itself.<br />

a. Nature <strong>of</strong> Proceedings. Hearings will be open to claimants, their representatives, witnesses,<br />

designated agency <strong>of</strong>ficials, and any other persons whose presence the Hearing Representative<br />

deems necessary. The proceedings are informal and are not limited by legal rules <strong>of</strong> evidence or<br />

procedures. The testimony will be taken under oath and recorded verbatim.<br />

b. Pre-hearing Conference. The claimant must request any pre-hearing conference to clarify<br />

the issues at least five days before the scheduled hearing date. This request must be in writing.<br />

The granting <strong>of</strong> such a conference is solely within the discretion <strong>of</strong> the Hearing Representative. If<br />

necessary, the Hearing Representative will postpone the hearing for this purpose.<br />

c. Preliminary Matters. Before opening the proceedings, the Hearing Representative will<br />

explain to all parties present that hearings are non-adversarial in nature and that the claimant will<br />

have the opportunity to present any written or verbal evidence desired.<br />

d. Opening the Hearing. At the beginning <strong>of</strong> the proceedings the Hearing Representative will:<br />

(1) Note the date and time;<br />

(2) Identify all persons present by name;<br />

(3) Make an opening statement which outlines the issues in question and ask the<br />

claimant if he/she concurs;<br />

(4) Afford the claimant an opportunity to make an opening statement; and<br />

(5) Administer an oath to all persons testifying.<br />
