2-0901-9 Special Determinations<br />

9. Special Determinations. This paragraph describes the rules for computing compensation to certain<br />

groups <strong>of</strong> employees.<br />

a. Census Workers. Pay rates for these employees are addressed in <strong>FECA</strong> PM 2-0900.12.<br />

(1) Where disability did not exceed 90 days, compensation should be paid on a daily<br />

basis according to Section 5 U.S.C. 8114(c).<br />

(2) Enumerators and crew leaders ordinarily worked 4.5 hours per day, 4 days per week.<br />

Where disability extended beyond 90 days and the<br />

claimant had similar<br />

employment during the year prior to the injury, compensation should be paid according to section 5<br />

U.S.C. 8114(d)(1)<br />

and (2). Otherwise, it should be paid on a weekly basis using<br />

the following formula: 150 x the actual daily wage divided by 52 (the actual<br />

daily<br />

wage should be determined by multiplying the hourly pay rate by 4.5 hours).<br />

(3) Likewise, the compensation <strong>of</strong> Clerks, Lead Clerks, Data Entry Clerks, and Lead Data<br />

Entry Clerks who are disabled longer than 90 days and<br />

who have had similar<br />

employment during the previous year should be determined using Section 5 U.S.C. 8114(d)(1) and (2).<br />

b. Firefighters.<br />

(1) Regular Firefighters. These employees normally work three 24-hour shifts per week.<br />

Compensation entitlement should be computed using<br />

the number <strong>of</strong> hours lost<br />

divided by 24 hours to arrive at the number <strong>of</strong> "work days" lost. The result <strong>of</strong> this computation should be<br />

divided<br />

by three, which represents the number <strong>of</strong> work weeks lost. The result<br />

should be multiplied by 3/4 or 2/3 <strong>of</strong> the pay rate to arrive at the<br />

amount <strong>of</strong><br />

compensation to be paid. This formula is:<br />

Hours lost/24 = Work days lost<br />

Work days lost/3 = Work weeks lost<br />

Work weeks lost x Comp rate x Weekly pay rate = Amount payable<br />

(2) Emergency Firefighters. The workday and workweek for firefighters recruited on an<br />

emergency basis by the Forest Service, <strong>National</strong> Park Service, and Bureau <strong>of</strong> Land<br />

Management (other than those who are "career seasonal" as outlined in <strong>FECA</strong> PM<br />

2-0900.4a) may exceed eight hours per day and five days per week.<br />

On an actual daily basis, the daily pay rate is the number <strong>of</strong> hours actually worked times<br />

the hourly pay rate reported, and compensation will be computed on the workweek<br />

reported. In other cases, the minimum weekly pay rate is determined by the following<br />

formula:<br />
