(b) Formal Decision. If a formal decision is being issued, the reply should note<br />

that if the employee disagrees with the decision, he or she may pursue the courses<br />

<strong>of</strong> appeal described in the decision.<br />

(3) Signature Level. DDs or RDs are to sign all Congressional responses. This duty may<br />

not be delegated to lower-level employees.<br />

(4) Tracking. Inquiries are monitored using the Priority Correspondence tracking<br />

function in Sequent, or on a separate system established for priority letters referred by the<br />

NO.<br />

c. Decisions and Other Case Actions.<br />

(1) Other Case Actions. Development <strong>of</strong> the claim, authorization <strong>of</strong> medical care, and<br />

payment <strong>of</strong> compensation should not be delayed while replies to correspondence are being<br />

prepared.<br />

(2) Release <strong>of</strong> Decisions. Formal decisions should be released before or concurrently<br />

with the reply to the priority correspondence.<br />

(3) Follow-up Replies. The DD should ensure that any further reply promised in the<br />

initial response is in fact prepared within the time frame stated. If a further reply has been<br />

promised "when the decision is made", the DD should ensure that the case is "flagged".<br />

2-0300-6 Controlled Correspondence<br />

6. Controlled Correspondence. This paragraph addresses letters referred by the NO to the DO for<br />

response. Replies and case actions are handled as described in paragraphs 5b and 5c above.<br />

a Definition. Controlled correspondence includes letters addressed to the Secretary <strong>of</strong> Labor<br />

or Assistant Secretary for ESA which require responses according to DOL policy (see DLMS<br />

Handbook 1-200). It also includes any letter so designated by the Office <strong>of</strong> the Assistant Secretary<br />

for the Employment Standards Administration or the Office <strong>of</strong> the<br />
