2-1600-1 Purpose and Scope<br />

1. Purpose and Scope. This chapter outlines the appeal rights <strong>of</strong> claimants who have been issued<br />

formal decisions by OWCP. These rights include hearing, reconsideration, and review by the Employees'<br />

Compensation Appeals Board (ECAB). This chapter summarizes the authority, responsibilities and<br />

definitions which apply generally to hearings, reconsiderations and appeals.<br />

Applications for hearings are processed by the Branch <strong>of</strong> Hearings and Review within the <strong>National</strong> Office <strong>of</strong><br />

DFEC, and the applicable procedures are discussed in Chapter 2-1601. Applications for reconsideration<br />

are handled by District Office personnel as outlined in Chapter 2-1602. Applications for review by the<br />

ECAB, which is an entirely separate entity from OWCP within the Department <strong>of</strong> Labor, are discussed in<br />

Chapter 2-1603.<br />

2-1600-2 Authority<br />

2. Authority.<br />

a. Decision. 5 U.S.C. 8124(a) provides that the Director <strong>of</strong> the OWCP, under delegation from<br />

the Secretary <strong>of</strong> Labor, shall determine and make a finding <strong>of</strong> facts and make an award for or<br />

against payment <strong>of</strong> compensation after:<br />

(1) Considering the claim presented by the beneficiary and the report submitted by the<br />

immediate superior; and<br />

(2) Completing such investigation as is considered necessary. In this connection, see<br />

<strong>FECA</strong> PM 2-1400.<br />

b. Hearing. Section 5 U.S.C. 8124(b) states that a claimant not satisfied with a formal<br />

decision is entitled to a hearing by an OWCP representative if the request is made within 30 days<br />

<strong>of</strong> the date <strong>of</strong> the decision. This provision, which applies to injuries occurring on and after July 4,<br />

1966, includes the stipulation that any such request must be made before reconsideration under<br />

Section 5 U.S.C. 8128(a) is undertaken.<br />

Apart from the hearing provided under 5 U.S.C. 8124(b), OWCP also provides the opportunity for<br />

an oral pre-recoupment hearing on the issues <strong>of</strong> fault and waiver, to anyone who is notified <strong>of</strong> an<br />
