d. Timeliness <strong>of</strong> Filing. A person residing within the United States or Canada must file<br />

application for review by the Board within 90 days from the date <strong>of</strong> OWCP's decision, and a person<br />

residing elsewhere must file within 180 days.<br />

For good cause shown, the ECAB may waive a failure to file an application within 90 days or 180<br />

days, but for no more than one year from the date <strong>of</strong> the final decision.<br />

3. Requests for Appeal and Information about Board Procedures. Requests for appeal must be in<br />

writing and sent directly to the Board in accordance with the instructions that accompany formal OWCP<br />

decisions. Any correspondence addressed to the Board but delivered to OWCP will be forwarded to the<br />

Board immediately, unopened.<br />

Occasionally, a written request for appeal will be addressed to OWCP. When the district <strong>of</strong>fice receives<br />

such a request, a Claims Examiner (CE) or Supervisory Claims Examiner (SCE) will review the case record<br />

to determine whether a final decision has been issued. If so, the request will be forwarded to the Board<br />

and the CE or SCE will release a letter informing the requestor <strong>of</strong> this action and advising that all<br />

correspondence relating to an appeal should be sent to the Board (Exhibit 1).<br />

If a final decision has not been issued, the requestor should be advised that the Board will review only<br />

final decisions and informed <strong>of</strong> the requirements for obtaining such a determination.<br />

Persons requesting information about Board procedures should be informed that the Board is a separate<br />

entity from the OWCP and operates under its own explicit rules <strong>of</strong> procedure, and that any inquiries about<br />

those procedures must be directed to the Board. The ECAB is responsible for providing replies to all<br />

inquiries concerning the rules and procedures under which it operates.<br />

2-1603-4 Transfer <strong>of</strong> Case Files<br />

4. Transfer <strong>of</strong> Case Files. Instructions for transferring case records to the <strong>National</strong> Office are<br />

contained in <strong>FECA</strong> PM 1-501.7. After docketing a case for appeal, the Board serves upon the Director a<br />

copy <strong>of</strong> the application for review and any accompanying documents. The Director must then transfer the<br />

case to the Board within 60 days <strong>of</strong> the date <strong>of</strong> service.<br />

The <strong>National</strong> Office requests cases docketed for appeal from the district <strong>of</strong>fices over the automated<br />

system. These cases should be transferred within 48 hours. Form CA-58 should indicate clearly that the<br />

case is to be sent to the ECAB, and district <strong>of</strong>fice personnel should ensure that all parts <strong>of</strong> the file are<br />
